If all they had on Pettaway was the butt, that would be one thing, and the acquittal is justified based upon that but, with this lazy ass detective work you have wonder if there could have been a lot more that just wasn't followed up on. I'm still appalled that Matt Yockey's word was all it took to dismiss AP as a suspect. Not that I think he was there - I don't know - but he should have been LEGITIMATELY eliminated through solid investigation.

Pettaway's murder charges dismissed by judge

Cameo Pettaway went home a free man Thursday, nine months after his arrest for the brutal slayings of a Springfield Township couple.

Citing a lack of sufficient evidence, Lucas County Common Pleas Judge James Bates dismissed all charges against Mr. Pettaway Thursday afternoon, after a jury heard 3 1⁄2 days of testimony but before the trial got to the jury deliberation stage.

Mr. Pettaway, 23, and co-defendant Samuel Williams, 24, were each charged with aggravated murder in connection with the deaths of Lisa Straub and Johnny Clarke last fall.

DNA of each of the two accused men was found on a cigarette butt collected from inside the Straub home where the couple were suffocated with plastic bags over their heads and strangled by duct tape wrapped tightly around their necks.

A jury hearing Williams' case began deliberating Thursday afternoon but stopped about 9 p.m. and was sequestered in a hotel.

"All of the critical objects were taken by the [Bureau of Criminal Investigation] to be analyzed -- bags, duct tape, knives, butcher blocks, cell phones," Judge Bates said. "The house was trashed. Drawers were opened. Objects were taken and thrown around, and other than the cigarette butt, nothing has anything to do with Cameo Pettaway."

He said he was expecting the cell phone records presented by prosecutors to implicate Mr. Pettaway in the January, 2011, slayings, but if anything they did the opposite.

"I thought this is really going to put Mr. Pettaway in Holland during this critical time period," the judge said. "If anything the cell phone records showed that Mr. Pettaway may not have been at the scene. I'm surprised that the cell phone records were even utilized in evidence."

He said it was a difficult decision, but that he was "required by law" to dismiss the charges after defense attorneys made a motion for acquittal.

Because of double-jeopardy law, Mr. Pettaway cannot be tried again on the charges

"This is a horrendous fact situation," Judge Bates said. "… Two young lives were taken for no apparent reason, but the question still remains, at least in this case, of who took those two young people's lives."

The Straub and Clarke families left Judge Bates' courtroom in tears without comment.

Lucas County Prosecutor Julia Bates also declined to comment on the verdict, saying there was still a gag order in place, and she was bound by the court not to speak about the case until the order was lifted.

Mark Geudtner and Merle Dech, attorneys for Mr. Pettaway said the same, although both smiled and embraced Mr. Pettaway's mother, Kenyatta Baker, and stepfather, Jermaine Baker, as they waited for his release outside the county jail.

"God gave us a victory," a grateful Mrs. Baker said.

"I'm still at a loss for words," Mr. Baker said, adding that he and his family want to send their condolences to the Straub and Clarke families.

"The thing that hurt me most about this is I know these families are grieving. I feel their pain. I lost a brother to murder so I understand that, but you have to want to seek justice, not vengeance."

While the Bakers waited outside the jail for Mr. Pettaway to be released, they learned deputies had taken him to Wood County on an outstanding misdemeanor warrant from Perrysburg Municipal Court.

Bond was posted by a family member while Mr. Pettaway was en route to Bowling Green, and he was released.

Mrs. Baker said she and other supporters have prayed for justice, and she prays for the Straub and Clarke families too.

"We want the people to get the victory, to find the killers because if that was my kid, I would want that," she said, adding that when her son was locked up she felt like she'd lost him.

"It was awful for us to lose our kid too. What they didn't understand was you aren't the only one losing a kid. He's got five kids and he's a really good dad. He lost a lot in this."

Mrs. Baker said she did not believe Williams, a childhood friend of her son's, was involved in the murders any more than her son was.

"It's been a horrible thing," Mrs. Baker said.

"I don't know how that cigarette butt got there. I don't have an explanation. I don't know, but I just don't believe those two did it."

I need a mathematical genius hah on here to help me figure out this business with the car, car has 30K miles and 6 months later thats about 24 weeks later in or around there, the car jumps to 105K, what were Johnny and Lisa up to? where were they going? I know they went to Florida, maybe Miami. Well that's about 2,500 miles round trip, I'm just trying to understand the long haul driving to put that many miles on a car in only a few months. Maybe they were caught up in some hellish deal.
Where do two kids get the money for fuel and eats, Johnny didn't work some kids can barely scrape up enough to get to Cedar Point.

I thought Detective Kozak did the best job he could and the other Detective Williams there is another one Ross I think, Kozak worked night and day on this case, he only had so much to work with, he didn't even take a vacation last summer with his family this is a man that wanted these killers tracked down, I'm still Praying for him I hope he gets a big win! I thought Tiffany Williams was given a poly and gave DNA and I thought Aaron Griffin was cleared. We are looking for a Psycho here & Psycho bitch.

Detective Kozak, apparently looked and acted like he knew nothing about his own case that he supposedly spent so
much time on. Those of us that have followed this case since the very beginning, know the players, inner circle,
and outer circle of friends and associates by name and how they are related to this case. Kozak didnt know squat.

I still believe Maytee is involved. Needless to say my job puts me around lots of people who are killed. Currently I am assisting a wife of a man who killed himself. Despite their strong faith she has a lot of guilt but it was clearly not her fault. I am watching the 5 stages of grief unfold with her.

With Maytee she has not displayed the 5 stages. It's all over the top all the time. I have seen this reaction ONLY in people who later were found to have involvement.

And yes LC, we are all coming out of the woodwork tonight.

Owl, 75,000 miles driven in 6 months is 12,500 miles per month (just averaging here). Many car insurance companies will up your premium if you exceed 14,000 miles per YEAR.

Apart from truck drivers, I've never heard of anyone putting that much mileage on a car. I personally can't see this being recreational miles; almost always, you see this kind of mileage in a cross-country CDL driver situation. Bottom line is that averaging 12,500 miles a month when most people drive 14,000-16,000 miles a year should raise some eyebrows. That's a lot of road to cover, a lot of people to meet, and a lot of enemies to make.

I'm going to throw a bunch of numbers at you so hang in there with me.

75,000miles/6months = 12,500/miles a month (average)

Driving 1,600 miles nonstop takes around 26hrs to complete (granted, LOTS of factors come into play with this, just doing a reasonable estimate based on reasonably consistent results from googlemaps)

1,600 goes into 75,000 46.875 times.

Since now we know how many times 1,600 goes into 75,000 (46.875) and we know that 1,600 miles take approximately 26hrs to complete, here's our math:

46.875 x 26hrs of driving = 1,218.75 total hours of driving in 6 months.

To simplify this (too late for that) lets just round it up to an even 1,219 total hours of driving in that 6 month period.

1,219/6months = 203.16....hrs of driving time per month (again, just averaging). We can round that up and make it an even 203hrs of drive time per month.

One month has about 730.484 hrs in it...again, lets round that to an even 730hrs.

So if there are approximately 730hrs in a month and Johnny's car was driving on average 203hrs per month, that would mean that Johnny's car was on the road nonstop for 27.80% of any given month for 6 months straight.

If anyone wants to check my math that's cool...its crazy early here.

Anyway, (x/y * 100 = the %). So that's 203⁄730 = 0.2780.

0.2780 x 100 = 27.80 (27.80% in this case).

Granted these estimates; some months might have had heavier driving than other months. However, that's not the point, the point here is to give you a better idea of how extreme this amount of driving was.

To give better perspective,

I'm gonna freak if while doing all this someone posts that the mileage driven was miscommunicated in court lol. Believe it or not, math drives me nuts.

Continuing my previous post really quick.

To help give a better idea of this in day to day life, if Johnny's car was driving 203hrs a month on average and there's lets just say 30 days in a month, that is 6.76 hrs of driving PER DAY. Again not saying this is exactly what was driven per day, just giving an average and an idea of how extreme this is.

I'm really beginning to wonder if something wasn't communicated well in court about Johnny's car mileage because this is an insane amount of driving. Then again, we have seen stranger things lately Smiley_emoticons_smile

A couple things I remember from yesterday: Det.K said since they knew there was unknown female DNA that they checked all females that were brought in/volunteered for questioning with a buccal swab.

When Bates gave his ruling for aquital the 13 "Action" cameraman called the station immediately. He told the person on the the other end that Bated had just aquitted CP---He repeated that twice and finally said--Dude are you dense??? Are you listening to me???

The man that was hyperventilating yesterday was CP's step daddy.

Well at least my headache is gone today--praying the Straub's are doing ok--it's a beautiful morning here in T-town---Nice day for a guilty verdict!!!! I am leaving for Detroit for weekend-and hope the verdict comes down before I have to leave! From one hell hole to another! LOL

Maytee has been on 13abc's Facebook page commenting on the post they made about her interview and being "barred from the trial". I picked a few to post.

EN: I'm sorry, and i'm sure i'm going to get some feedback, but, it's her own fault she couldn't be there.

I've had family taken by others, but when it comes down to it, you have to compose yourself. Lisas' parents were able to calm down enough to be in the court room.

I feel bad that she's had this horrific thing, but i can't say i feel bad for not being able to be present. Even here on the news FB pages, she sounds like a nut case. It's okay to be anger, but composer, and class are key.

I would want to see the rotten f#ckers fry - but had they tried the case without sufficient evidence, the S.O.B. would have gotten off scott-free. At least this way, they may be able to represent at a later time (unless it was dismissed WITH prejudice, but since the trials had not begun, I do not believe this will be the case). I have seen your posts on here and while you have EVERY right to be angry and hurt, you have a tendency to go a bit overboard and HKS is correct, you need to find a way to forgive if only for YOURSELF. GOD will seek retribution for the sins visited against your son. Please, for your own peace of mind.....
