I get a sense of satisfaction thinking that her very own words could play a role in her getting exactly what she deserves. She smugly posted threats for years. She was like a monkey throwing poop.

I'm not terribly worried either, but evidence does sometimes get tossed when judges rule the search was conducted without consent and without a warrant. It's irrelevant whether the area searched is occupied by a liar or the pillar of society.

In the motion to suppress, Maytee claims violation of fourth amendment rights. The motion specifies that she denied police entry and therefor her statements made to police, along with tangible evidence, should be suppressed.

But, as you noted, if police can establish that they had sufficient probable cause to suspect that John was the shooter and a danger to others, that he was in the residence, and that he would attempt to escape or destroy evidence, the judge could rule that the warrant-less search was legally conducted in accordance with the exigent circumstances exemption of the fourth amendment.

The motion hearing should be interesting.

It's my assumption that TW positively identified John as the shooter.

Unfortunately, they haven't started using the body cameras yet. I don't think they will be until next month and only 43 were purchased. I was browsing the bookings this morning and a nice mugshot of maytee as well as one of John popped up from the 10th.

HotD . . . I've always held your analysis in the highest regard.

Because you are rational . . . because you are exceedingly bright . . . because you have a true and genuine compass of fairness and compassion, I understand your position that the judiciary should be blind, as to an individual's character when they are wronged.

However, as this is a hearing and Maytee will be required to testify as to the events of the police entry, her lying pathology will work against her.

So . . . let's review!

If Big Pussy John was NOT involved in the shooting, there would be NO evidence to be found in the home and thus, needing exclusion.

If Big Pussy John was NOT involved in the shooting, there would be no need to deny the police entry, AS THERE WOULD BE NOTHING TO HIDE OR BE FOUND.

If Big Pussy John was NOT involved in the shooting, why was he hiding and why did she lie that he was not at home?

Lying Maytee WILL need to explain her actions, under oath and on the stand, at the hearing. Yeah, stupid self-righteous bitch is now being held to society's rules and procedures.

As there appears to be incriminating and direct evidence connecting them to the shooting, she would have an extraordinarily strong motive to save her ass by lying about the officers' entry.

Her published and prolific hateful comments about law enforcement and the judicial system also add to the motive to lie about the officer's actions.

Quite simply . . . who has the most to lose if the search and seizure is deemed to be lawful?

I don't it's law enforcement!

Maytee's lies and continued criminal conduct WILL work against her at this hearing.

I have confidence the Judge will see through her lies and her underlying contempt for all that is lawful.

I think all of your points are good ones which will be used against the Clarkes at trial.

I could be wrong, but in considering the motion to suppress, I believe the judge will make the determination based only on whether he is convinced that the search was legal -- by means of a warrant, or consent, or probable cause/exigent circumstances. I don't think the defendant's character or history of lying will be a factor in the pre-trial motion ruling.

Anyway, I think Maytee's motion to suppress will be denied if it turns out that TW or another witness told police that John Clarke took a shot at her. Even if the police claim Maytee gave consent and she denies it, the officers can probably make a strong case for public safety and possible escape being exigent circumstances to search without a warrant.

I believe that the specifics of statements and evidence, obtained during the alleged illegal entry and seizure, will become part of the the court record.

Maytee would never survive in prison.

I don't know if they'll turn on each other to cut deals, but it wouldn't surprise me if Maytee threw John under the bus. He might even go along with it to try to keep her out of prison.

I always think of Johnny's two litter brothers.

Their lives seem to be less important to Maytee and John than Johnny's death and their criminal pursuits.

I hope CPS has taken them out of that environment and they're some place under the supervision of decent people.

When a woman continually professes her love for her adult son instead of her husband, you know there exists a continued and palpable loathing of Big Pussy John.

I remember reading (years ago) it was suggested that Maytee was really Big Pussy John's Beard. He allegedly started preferring men after his stint in prison. I tossed it off as web gossip.

However . . . Maytee always used the word "HOMOcide" when describing the murder of Johnny.

Maybe coward Johnny turned out like Big Pussy John after his incarceration, too?

I want to feel positive that they will get what they deserve & I want to wallow in smugness watching it all go down but sometimes my faith wavers. Watching the justice system at play has slapped me down more than once.

I doubt any defense attorney would put her on the stand . . . a strong prosecutor would cut her to pieces.

She'd never be able to handle a strong cross examination. Look how she crumbled when interviewed by JVM.

She is not nor ever was a strong, principled woman or mother.

Even if there were questions about legality of the search by LE, wouldn't "probable cause" apply here? I know little to nothing about this stuff, but even if Maytee says she didn't consent to search, wouldn't probable cause apply here making the search "legal" in eyes of the law?

Yes, probable cause and exigent circumstances could justify a search without consent and without a warrant blueberry. It's covered in a few of the posts over the last couple of pages.

If there's no record that Maytee gave consent, then police can either try to convince the judge that she did and she's lying, or they can argue that they didn't need consent nor a warrant under the circumstances.

Personally, I believe they'll do the latter.

Yup. I heard about that a few months ago. I was told that the oldest son pretty much lived with the girlfriend's family, that may have changed since then and that the little one was still at home, he was described to me as being "lost".
