The mother of a 2-year-old Detroit girl who has been missing since December says she will continue to believe her daughter is alive until there's proof otherwise.

Banika Jones spoke exclusively with Local 4 Thursday morning. She continues to believe her daughter is alive.

The 2-year-old went missing Dec. 2, when her father, D’Andre Lane, said he was carjacked with the girl in the back seat. The car was recovered, but the girl wasn't inside.

Local 4 has learned that Lane is being held in the Oakland County Jail for violating a protection order in an unrelated case.

Lane will be arraigned Thursday on first-degree murder and first-degree child abuse charges.

Magistrate Steve Lockhart set bond at $3 million dollars for D’Andre Lane who is charged with first degree murder and first degree child abuse in the disappearance of his daughter.

Lane claimed he was carjacked at gunpoint by two men on Dec. 2 with 2-year-old Bianca Jones in the back seat. The girl has not been seen since. Lane was charged Wednesday even with no body found.

During his brief court arraignment on Thursday, Assistant Wayne County Prosecutor Karen Goldfarb argued for a remand with no bail, citing a previous criminal record of drugs and assault dating back to 1996.

Goldfarb said in court they have evidence of “Lane’s involvement in the death of his daughter.” She did not give any detail but said there are boxes of evidence and "considerable, compelling evidence of Mr. Lane's involvement in his daughter's death."

Lane's defense attorney Terry Johnson entered a non-guilty plea and asked for time to review the case. The preliminary exam is set for April 17. Johnson said in court he has seen no proof, only allegations and assumptions that Bianca is dead.

“Nothing is established that she is dead. We believe she is somewhere kidnapped or abducted,” said Johnson. "He still believes she is somewhere, kidnapped or abducted."

Johnson said the court is making assumptions without any hard evidence against his client.

D’Andre Lane The magistrate responded “it is highly likely the infant is no longer living” and said he is “extremely skeptical about statements” made by Lane after the carjacking.

Detroit— The father of Bianca Jones is due in court Tuesday afternoon for a preliminary examination on allegations he abused and killed the toddler.

D'Andre Lane of Detroit is charged with first-degree felony murder and child abuse. Bianca was last seen Dec. 2. Her body has not been found.

Lane's attorney, Terry L. Johnson, said the hearing in Detroit's 36th District Court is expected to include about 10 prosecution witnesses and could span several days.

I hope they have lots of evidence against him, I do not want to see another person go free after killing their very own precious child.

Bianca Jones' dad appears in court, disturbing testimony heard from 8-year-old daughter

"When the hearing began Tuesday afternoon, the first person on the stand was Lane’s 8-year-old daughter.

The little girl testified about a time she wet the bed, saying her father was so upset that he shoved her wet underwear into her mouth, causing a cut.

She also said that she did not see Bianca awake on the morning of December 2, the day of her reported kidnapping.

The girl told the court that Bianca had a blanket over her face when they left for school that day, and that Bianca didn’t say a word or move when her father put her into the car."

Detroit— The father of a missing 2-year-old who claimed his daughter disappeared after he was carjacked was ordered Tuesday to stand trial on first-degree murder and child abuse charges.

D'Andre Lane had claimed his daughter, Bianca Jones, was in the backseat of his 2004 Mercury Grand Marquis when he was approached by carjackers Dec. 2. The vehicle was found shortly after the alleged incident, but Bianca wasn't inside. Her body has not been found.

Carin Goldfarb, assistant Wayne County prosecutor, hammered home a 45-minute gap between phone calls Lane allegedly made the day of the incident. Goldfarb noted cell phone records had Lane making a call at 8:55 a.m. and then calling a friend at 9:40 a.m. It was the friend from the second call that dialed 911.

"The defendant was disposing of his dead baby's body," Goldfarb said. "That's what he was doing for those 45 minutes."

Prosecutors allege that Lane beat Bianca to death with an 18-inch stick with a towel wrapped in duct tape at the end.

Terry Johnson, Lane's Southfield attorney, said Lane "spanked" the child with the stick but that there was no evidence of child abuse or murder.

"Their whole case is based upon he spanked her," Johnson said Tuesday to 36th District Court Judge Ruth Carter. "The only established fact we know is that Mr. Lane spanked Bianca that night."

Carter disagreed. She brought up the testimony last month of Anjali Lyons, Lane's girlfriend. Lyons testified she was woken up to the sounds of Bianca screaming and being beaten on the morning of the day she disappeared.

"It woke her up, which speaks a lot to what was going on," Carter said.

Carter also said the earlier testimony of another of Lane's daughters, 7, was important. The girl remembered the morning of the disappearance her sister "didn't move" that morning.

Lyons said Lane often used the stick to discipline Bianca during potty-training. Lane admitted to using the stick, which he told police was "about the size of a pen" on the girls. "It's just to let them know they did something bad; you know what I mean?" Lane said, according to police transcripts read in court Tuesday.

Lane's next court date was scheduled for June 5 in Wayne Circuit Court.

Dad guilty in Bianca's death:

DETROIT — A Detroit father has been found guilty of murder and child abuse in the slaying of his missing 2-year-old daughter.

A Wayne County Circuit Court jury returned its verdict Friday against D'Andre Lane.

Lane told investigators that Bianca Jones was in his car when he was carjacked Dec. 3 on a Detroit street. The car was found but Bianca was not inside. Her has never been found.

Prosecutors accused Lane of fatally beating Bianca with a stick wrapped in a towel because she wet herself. They say he then disposed of her body.

The handler of a cadaver-sniffing dog testified at Lane's trial that the dog detected the smell of a cadaver in Lane's car and in Bianca's bedroom.

Hang him upside down by his balls till he tells where she is... I'm glad that he has been found guilty and will be put away. I'm just so tired of all these stories and no one saying anything anymore, so these babies can have a proper resting place. Even the other stories that don't involve the young ones, it's just building up in me and I can't take it anymore!

I hope Bianca's mum has come to terms with her being gone now. This guy has like 7 kids, at least he can't hurt any of the others now. I don't get the mentality of people, who thinks its ok to discipline a 2yr old for wetting themselves?
