ARREST MADE: Abigail Hernandez, 15, Missing/Returned Safe - New Hampshire
#81
First, I am so glad that Abigail is back home. That's the number one priority in a missing persons case. How many cases are there just on this site where the person hasn't been found (Susan Powell) or found dead (Katelyn Markham)? However, I can understand the people in her town who are looking for answers. There was a lot of money and manpower devoted to looking for Abigail, not to mention the nationwide media attention.

Didn't I read shortly after she returned home that she looked healthy? Not like a person who had been homeless for 9 months? I then went on to read her parents say she was very thin and unhealthy. That's quite a contradiction. I'd love to hear LE's theory.

The attorney general made a statement to that effect shortly after she came home.

LE isn't giving out a whole lot of info on the case......I still think she ran off to have a baby.

I think her boyfriend's dad has that suspicion as well.

From this morning's Huffington Post -- Abigail's Mother Denies Pregnancy Rumors

The mother of a 15-year-old New Hampshire girl reunited with her family nine months after she vanished says rumors that she was pregnant aren't true.

Investigators have been trying to find out how and why Abigail Hernandez of North Conway disappeared and who may have helped conceal her. She returned home July 20.

Zenya Hernandez tells NBC's "Today" that many people think her daughter was pregnant, but she was not. She also says she believes Abby did not run away and didn't know the man believed to have driven off with her. Police released a sketch of him based on Abby's description.

Abby issued a statement thanking people who searched for her and that she believes their hopes and prayers "played a major role in my release."

ARREST MADE FOR KIDNAPPING

Nathaniel Kibby, 34

An arrest has been made in connection with the October disappearance of a North Conway girl who returned home last week.

The Attorney General's Office said Nathaniel Kibby, 34, of Gorham, was arrested Monday and charged with one count of felony kidnapping for knowingly confining Abby Hernandez, 15, on Oct. 9, 2013, in Conway, New Hampshire, with a purpose to commit an offense against her.

Police said Kibby was arrested without incident at his home.

Officials said that over the past week, law enforcement officers have worked to determine what happened when Abigail disappeared and then returned nine months later. They said the details she gave police of her kidnapping led to Monday's arrest.

(Family friend Paul) Kirsch said he didn't have any knowledge of whether Abby knew who Kibby was.

Kibby is scheduled to be arraigned Tuesday at 1 p.m. in Conway Circuit Court. Police plan a news conference after his arraignment. Both will be shown live on WMUR-Channel 9, WMUR.com and WMUR's mobile app.

Kibby made a court appearance in December on a possession of marijuana charge. At that time, Abby had been missing for two months.

Whatever has happened I'm glad she's home with her family. Right up until I read of the arrest I thought she had something to do with her own disappearance. Reading the crime forum has made me a cynic. Smiley_emoticons_slash

For the last six months, I've considered it most likely that Abigail was missing voluntarily too. We still don't know if she took off willingly (at least initially) or not.

In any case, no one should feel bad for speculating that Abigail had a part in her disappearance or about why she might have left. Theorizing is what we do here and while it is not unheard of, it is extremely rare for an abductor to allow a captive to write a letter to a parent (and then to "release and return" a captive is even stranger).

When LE confirmed that the letter from Abigail to her mom was authenticated (and none of the contents therein were publicly disclosed), Abigail's friends and family began sending her messages asking her to come home (rather than pleading for someone else to release her). It was logical at that point to conclude that this might be one of the thousands of run away / voluntarily missing cases rather than a kidnapping. Based on their words and actions, IMO, that was always a possibility being considered by LE and some of Abigail's loved ones and supporters as well.

Anyway, I'm glad she's home too -- no matter the circumstances. And, I really hope tomorrow's arraignment and LE press conference will help fill in some of the pieces of the puzzle.

I still tend to lean towards the theory that she went willingly with this guy. In the eyes of the law, though, it doesn't matter whether she went willingly or not--she's a minor and the old saying '16 will get you 20' applies here. At 34, the guy should have known better.

The arraignment is being live streamed by WMUR at 1 pm EST.

Being that this is only an arraignment, we might not learn too much, but sometimes more details than anticipated come out during the process. The Attorney General's press conference after the arraignment will be streamed at the same link.

I'd really like to see the arrest and search warrants, but those have not been made public.

And that's how it came to pass that on the second to last day of the job, the convict crew that tarred the plate factory roof in the spring of '49 wound up sitting in a row at ten o clock in the morning drinking icy cold, Bohemia style beer, courtesy of the hardest screw that ever walked a turn at Shawshank State Prison.

- maybe my favorite scene from the entire movie
