Kibby's trial is set for 2016.

The charges are the same as last posted (kidnapping and rape on several counts).

The family has requested and the court has agreed to keep the victim's name out of media moving forward since she was a minor at the time of the alleged abduction.

A judge has ruled against most of the motions filed by a man accused of kidnapping and raping a 14-year-old girl but did allow some evidence to be excluded.

In a 45-page response, Judge Larry Smukler denied most of the motions filed by lawyers for Nathaniel Kibby, 35, of Gorham, who was accused of kidnapping and assaulting a North Conway teenager in 2014.

Kibby's defense team argued to have Associate Attorney General Jane Young recused from the case after the Attorney General's Office said Kibby was recorded making lewd, violent threats against her during a phone call from jail.

The defense claimed Young can't be a victim and a prosecutor, but the motion was denied.

Most of the defense motions focused on 55 pieces of evidence Kibby claims was unlawfully taken from his Gorham trailer in what his attorneys called a fishing expedition. Some of the disputed evidence includes masks, sex toys, DVDs, CDs, a laptop computer and a video camera.

The motions were all denied with one exception. Investigators removed a number of firearms from Kibby's home during a search for two particular weapons, a long gun and a handgun described by the victim.

Prosecutors did not object to the suppression motion for the additional firearms, and the motion was granted.

Kibby also sought to have several sexual assault charges dismissed, but Smukler denied most of those motions. Motions on two charges were deferred, pending the resolution of a motion from the state.

Kibby also was seeking access to the victim's medical history and records since birth. Prosecutors have already provided medical records since 2004, and the judge ruled that Kibby's defense team is not entitle to additional records.

The trial has been postponed until June, I believe. So it will be almost 2 years. Pretty normal. Want to know just what Kibby said to cause Trooper Berube to state "everything comes to an end sometimes". The troopers testimony is in, that's a good thing. But, it is what Kibby said to prompt the trooper's words that I want to hear. Still can't believe that Kibby never asked for a modification of bond hearing. Guess he and his lawyer thought it would be a lost cause? and didn't want the prosecution to be able to publicly give out testimony as to why?

Trial Update

Nathaniel Kibby faces 200 charges in two counties for allegedly kidnapping a then-14-year-old girl on Oct. 9, 2013 in Conway.

Last month, prosecutors asked the court to consolidate the Carroll County and Coos County cases and move them to Belknap County to be tried under a single judge. The defense agreed and the court approved the request.

The trial was originally slated to begin in March. It was pushed back to April. Currently, it's scheduled to begin on June 20, 2016.

The judge will hear pending motions the first week of June. Among them is Kibby's motion to suppress the following evidence: two laptop computers; a "Scream" style mask; DVDs and compact discs; firearms; a printer; a container of women's clothing; a black-and-gold mask; still and video cameras and a mobile GPS unit from Kibby's Honda Civic, which AG Young said was the vehicle used to return the alleged victim to her home.

Seems like the first job requirement for anyone wanting to be head usher for the deepest seats in Oblivion would be actually knowing how to spell "oblivion."

What does that even mean, anyway, "deepest seats"? Is that like ground floor seats near the front of oblivion? Maybe near the infernal orchestra? Because that'd be cool I guess unless there's a mosh pit. I'm thinking an oblivion mosh pit might get a little rambunctious , and there's a splash zone to think about. I don't wanna pay extra for the best seats in oblivion and get my nice clothes all jacked up. You can't get blood out of silk, I tried.

How much trash do I have to talk about Abigail or the Psycho Paths to get a balcony seat in oblivion? For two, because I'll want to bring a date. Also, does my date have to be a Psycho Path or is "plus one" okay?

But, LE officials and court docs indicate that AH is the minor victim of kidnapping and rape. She's off limits.

GUILTY PLEA

A man who initially denied kidnapping a 14-year-old girl and raping her repeatedly during nine months of captivity changed his plea to guilty on Thursday -- with the girl in the courtroom to witness it.

Nathaniel Kibby had been scheduled to go on trial next month in Laconia on nearly 200 felony charges related to the girl's October 2013 disappearance and the months that followed. He acknowledged his crimes during a change-of-plea hearing Thursday in Belknap County Superior Court, where corridors were packed with police officers and FBI agents who worked the case.

Kibby pleaded guilty to aggravated felonious sex assault, kidnapping, criminal threatening, witness tampering and other counts. He has been sentenced to 45 to 90 years in prison.

Before Kibby could enter his new plea, a prosecutor said Kibby had kidnapped the girl by offering her a ride home from her school and then brandishing a gun when she attempted to get out of his car.

Prosecutor Jane Young said the girl and Kibby didn't know each other and she accepted a ride because she'd worn boots to school and her feet were blistered. Young said when the girl tried to get out of the car in a parking lot Kibby pulled out the gun and threatened to "blow her brains out."


AH is a survivor; I'm glad she was able to watch her assailant be held accountable for his crimes. I'm still curious how she managed to convince Kibby to let her go.

They caught him because he was using counterfeit money he made to pay for prostitutes. He put a dog shock collar around her neck in case she ran. He was presented with the undeniable evidence and went for the guilty plea. The only thing he did that was in any way noble was to plead guilty. The victim forgave him in court and as a captive for 9 months I can understand that. Books will be written in the future about this and I hope this young woman gets rich and becomes an advocate for any and all abuse victims. I personally hope justice is served in jail.
