CAPE GIRARDEAU, MO (KFVS) - According to a supplemental affidavit submitted Monday, Clay Waller's father says Clay went to him a few days after Clay's estranged wife's disappearance and confessed to killing her.

Clay Waller had another court appearance Monday.

It was a continuance from last Thursday's detention hearing, during which Assistant United States Attorney Larry Ferrell released details surrounding the disappearance of Waller's estranged wife Jacque.

The federal prosecutor is trying to convince the judge that Waller should be held without bond because Ferrell says evidence indicates Waller is responsible for the woman's murder.

Because of federal rules, a deposition is not allowed in this type of hearing. Instead, the judge allowed the supplemental affidavit of Waller which was provided by an FBI agent.

According to the supplemental affidavit, a few days after Jacque went missing he confessed to his father that he killed Jacque.

Clay told his dad the hole was already dug and he buried her with a shovel, according to the affidavit. While telling his father how he allegedly killed Jacque, he made a motion with his arm consistent with breaking her neck. According to the document, he was crying and emotional when confessing.

James Waller Sr. told his son to turn himself in to authorities or seek psychiatric treatment, according to the supplemental affidavit.

In court on Monday afternoon, Assistant Federal Public Defender Scott Tilsen questioned the reliability of that affidavit.

Tilsen said according to some family members, James Waller Senior is an ill man in the nursing home who has not only physical ailments, but moments where mentally he is not a rational person.

That statement prompted comments from JC Waller, Clay Waller's son. The 19-year-old has not spoken publicly about the case until now.

JC Waller told Heartland News reporter Crystal Britt that he goes to see his grandfather, James Waller, on a weekly basis and says he is mentally sound.

Waller, 41, is charged with first degree murder and two counts of tampering with evidence in connection with his wife, Jacque Waller, according to Cape Girardeau County Prosecutor Morley Swingle.

Jacque Waller has been missing since June 1, 2011. Her body has not been found. She was 39 at the time of her disappearance. Jacque and Clay had 5-year-old triplets at the time of her disappearance.

Clay and Jacque were going through the process of divorce. According to court documents, Clay Waller signed documents to start the divorce process, but would not leave them with his lawyer. He encouraged her to do the same, according to court documents.

Jacque had talked to her sister over the phone around 3:50 p.m. on June 1 and told her she was going to pick up her son from Clay's home and return "straight home." She then talked to her boyfriend on the phone around 3:56 p.m. and told him she was picking up her son and would return home.

According to court documents, Clay's girlfriend told police she and Clay were supposed to have dinner together with his son and one of her children, but he met her at a local business parking lot and indicated to her he would not be having dinner with them. He later asked her to keep his son overnight at her home, which she had never done before with Clay not there also.

The homeowner and a neighbor told police they saw Jacque's Honda Pilot at Clay's home and later saw Clay leave in his truck pulling a boat.

On Monday, June 6, investigators found blood splatter on the walls of a darkened hallway. It did appear an attempt had been made to clean the walls, according to court documents. The DNA profile of the blood from the hallway was the same DNA profile as Jacque.

Statement from Jacque Waller's family on murder charges
This morning, Morley Swingle, Prosecuting Attorney for Cape Girardeau County (MO) filed first degree murder charges against Clay Waller in the disappearance of his wife, Jacque, last June 1. He is being held on a one million dollar bond.

Speaking on behalf of his family, Jacque's father, Stan Rawson said, "There is a bit of relief in knowing that charges have been brought against Clay Waller. Perhaps he will finally feel compelled to reveal the location of our daughter and sibling, mother and friend, Jacque Waller. We are extremely grateful to the law enforcement team that has spent countless hours investigating Jacque's disappearance as they put together their case against Clay. The case is now in the hands of the prosecuting attorney, and we are confident that we will now finally get justice for our girl. Over the last ten months we been the recipients of amazing support from people around the world; we are especially thankful for their many prayers and good wishes and ask that those continue. What we want more than anything, however, is to have Jacque home with her family and finally at rest. We ask that people respect our privacy as the case against Waller unfolds. It is now in the hands of the courts."

Jacque Waller went missing last June 1, 2011, after meeting her estranged spouse, Clay Waller, at their divorce attorney's office. Her abandoned car was subsequently found near the Fruitland, Missouri, exit on I-55. Since then hundreds of hours have been spent by both law enforcement and volunteers combing Cape Girardeau County searching for Waller and evidence in the case. Waller was 39 at the time of her disappearance and had just made arrangements to move to Farmington, Missouri with her triplets, then five years old. Since that time, they have been living with Jacque's sister and brother-in-law who have temporary custody of the children.

Waller is currently serving five years on federal charges for making Internet threats against Jacque's sister, Cheryl Rawson Brennecke.

On June 8, investigators searched a crawl space and found broken spider webs and it appeared the dust on the floor of the crawl space had been disturbed.

Investigators found a large amount of green carpet cut into several pieces in the crawl space. Areas of the carpet had apparent blood stains and blood pooling was evidence on the carpet. The blood matched the DNA of Jacque's.

Clay told investigators Jacque's nose had started bleeding while in the house and she tripped on the green carpet as she ran to clean it up.

Clay told investigators he had removed the carpet from the hallway because he did not want the owner of the home to find it and think something bad happened, according to court documents.

Clay then told police after Jacque was cleaned up, they began to argue about financial issues. He said he became angry and threw her keys into a tree. She told him she would walk to a friend's house and he watched her walk away. He said she had her purse with her when she left. He then told investigators he got a broom handle to get the keys from the tree and put them on the windshield of her vehicle.

According to court documents, Clay then said he left the house, but did not take his cell phone with him. He said over the next few hours, he drove around the Cape Girardeau area and at time would leave his truck to use the bathroom in wooded areas. He also told police he would park roadside to read or work on crossword puzzles or work on the boat that was attached to his truck.

Jacque's laptop was recovered and police found a diary in which she detailed alleged threats from Clay threatening to kill her if she left him, according to court documents.

A Missouri Department of Transportation worker found a camera bag in a ravine on Nov. 3, 2011 in a ravine on the southbound side of Interstate 55. That is across from where Jacque's Honda Pilot was found abandoned on June 2.

The last phone calls to come from Jacque's cell phones were at 6:02 p.m. to a co-worker and 6:03 p.m. on June 1 to Clay's cell phone. Both were missed calls.

The area had recently been mowed. Jacque's purse, parts of cell phones, her driver's license, credit cards and other items thought to be from Jacque's purse were found.

Court documents say Clay was "largely uncooperative, and at times, intentionally obstructive to the investigation by concealing/destroying suspect evidence, planting false evidence and deliberately misleading officer in their effort to locate his wife."

Waller is currently in a Louisiana prison. He was sentenced to five years behind bars in federal court after pleading guilty to threatening his sister in law on the website Topix last year.

In a released statement, Jacque's family said there is a bit of relief in knowing that charges have been brought against Clay Waller and they are looking for forward to getting justice for Jacque.

The husband of a Missouri woman who has been missing for nearly a year was charged with first-degree murder Monday even though his estranged wife's body has not been found.

Clay Waller, 41, also was charged with tampering with evidence in the death of his estranged wife, Jacque Waller. Jacque Waller was 39 when she disappeared June 1.

Clay Waller already is in federal prison for threatening his wife's sister, who has been caring for the couple's 5-year-old triplets since their mother's disappearance. He does not have a listed attorney.

"There is a bit of relief in knowing that charges have been brought against Clay Waller," Jacque Waller's father, Stan Rawson, said in a statement. "The case is now in the hands of the prosecuting attorney, and we are confident that we will now finally get justice for our girl."

They have him in custody, he confessed to his own father and there is blood evidence. Clay needs to man-up and show/tell LE where he dumped Jacque's body. If he loves his kids he needs to do it for them.

Hell, I don't care if they take a few years off his sentence, but her body needs to be recovered and laid to rest for the sake of her children and family.

BODY FOUND

-No details as to where or how the body was found have yet been released.

-Jacque was missing for two years when her body was discovered on Wednesday.

-Jacque's POS husband, Clay Waller, with whom she was in the process of a contentious divorce when she "disappeared", is in jail on a 5 year federal sentence for threatening Jacque's sister, Cheryl Brenneke, over the internet after Jacque's disappearance.

-Clay Waller's murder trial is scheduled to begin in a few months, September 2013. He pleaded "not guilty" to the charges in August of last year.

There's a lot of circumstantial evidence against him, as detailed upthread. Now that LE has a body, the case against him is much stronger; no chance for the defense to claim Jacque ran off and abandoned her family. Clay Waller's going down. IMO.

A message on the Find Jacque S Waller Facebook page posted Thursday said:
“It is with a heavy heart I deliver this message. Our daughter, mother, sister and friend has been found. God has planned everything well to place us in this very moment. God guided the law enforcement officials, searchers, K9s and most of all the prayers being sent to the prison to weigh heavily on clays mind. We thank everyone of you who has supported us and assisted us in this terrible nightmare. We have no arrangements as of yet but we will be able to lay our Jacque Sue to rest....finally. God Bless you all!”

Jacque's triplets are living with her sister, Cheryl.

If it was Clay who led to the discovery of the body, probably as good a chance that he did it because he's looking to plea and got something in exchange as there is that his conscience kicked into gear.

Hoping more details about how the body was located are released soon. Curious.

These kinds of murders happen way too much. Still, every time they do, I have a hard time comprehending how a man (and sometimes it's the woman) can resent their spouse/partner more than they love their own child(ren).

Glad that at least the Waller triplets have their Aunt Cheryl to raise them. They seem to be a very close and loving family. Those kids are gonna have a lot to process when they're old enough to understand, and they probably miss both of their parents now.

From my experience jelousy and revenge can lead people to thinking or doing some awful stuff you wouldn't usually do, without being wrapped up in your fucked up head.

Yeah, that's true.

There are also probably a lot of jealous lovers/spouses/exes who stop themselves from acting on fucked up revenge fantasies for their chidlren's sakes.

The ones who actually plan to take the chidlren's other parent away from them permanently and/or plan to lie to their own kids about it for the rest of their lives were probably fucked up individuals to begin with, in good times and bad. That's a level of selfishness that exceeds jealousy.

A frustrated judge, begrudging prosecutors and chagrined family members all conceded Thursday that offering a plea deal to a southeast Missouri man accused of killing his estranged wife, a mother of 5-year-old triplets who was missing for almost two years before her body was found last week on an island in the nearby Mississippi River, was inadequate.

But it was the best option available, they said, because 42-year-old James Clay Waller II was the only person who could lead authorities to Jacque Waller's body, while ensuring a conviction and offering grieving family and friends closure for the 39-year-old mother who disappeared in 2011.

Clay Waller was given a 20-year prison sentence Thursday after pleading guilty to second-degree murder and admitting in a barely audible voice – inside a packed Cape Girardeau County courthouse – that he'd murdered the triplet's mom. The shaken inmate struggled to admit choking his wife to death before dumping her body on an island on the Illinois side of the Mississippi River nearly two years ago.

Before being sentenced, Clay Walker also listened to his 7-year-old son publicly disown him for life, calling his father a "big, fat jerk."

"You killed our mom," the child said in a taped statement. "I thought you were a good guy. Now I know you're not ... I wish you weren't my dad."

Few left the courthouse satisfied with the outcome. Both Jacque Waller's sister and Circuit Judge Benjamin Lewis said they weren't happy with the lighter sentence, but had few options. The plea was conditional on Clay Waller II leading investigators to his wife's body and his confession in court. Her body wasn't found until May 29 in Alexander County, Ill., and Clay Waller continued to share details about the killing with investigators earlier this week.

"I did not want this deal," said Waller's sister, Cheryl Brenneke, who has custody of the triplets and plans to adopt the two girls and one boy. "My mother and father and these children deserved to bury her, though."

Lewis acknowledged that "there will be a number of people critical of this plea agreement. However none of those critics could provide the body of Jacque Waller."

"That is not what you deserve, but it will have to do," he said in handing down the 20-year sentence. Under the original charge, Waller could have faced the death penalty or life in prison without parole.

Twenty years. If Clay watches his act he could get one month off for every year served "good time". Eighteen years, four months if he keeps his nose clean.

I understand why the family agreed to this and sympathize with them. Sometimes you have no choice but to dance with the Devil.
