Dismissed: Officer Bert Lopez has 30 days to appeal his dismissal

A New Mexico state police officer has been fired after security cameras caught him having sex with a woman on the hood of a car.

The bizarre scene, which was witnessed by a nearby chihuahua, was filmed by a hidden camera set up by Santa Fe New Mexico police to catch vandalism at a nearby property.

Instead, it recorded uniformed officer Bert Lopez with an unidentified woman.

According to The Santa Fe New Mexican, Lopez has 30 days to appeal his dismissal.

The surveillance photos were taken from a motion-triggered security camera positioned at the front gate of the county-owned La Bajada Ranch south of Santa Fe. The encounter was at the remote Canyon Ranch.

Two photos showing a uniformed officer having sex on the hood were forwarded to Santa Fe Sheriff Robert Garcia, who identified the officer as being with New Mexico State Police. He forwarded the images to State Police Chief Robert Shilling.

Despite being on duty and in uniform, the police officer caught on film having sex on the hood of a car will not face any criminal charges

An internal investigation was immediately launched, and Lopez, an eight-year veteran, was put on paid administrative leave for about three weeks.

Police officials would not comment on whether the dismissal was an indication whether the officer was on duty at the time of the incident.

The dismissal came days after investigators said the officer didn't commit a crime. Officials were assured the sexual encounter was not in exchange for anything related to his position as a law enforcement officer.

'It is an embarrassing situation for the department, but we have to remember the rights of the employee afford him due process we must follow so we won't be commenting further,' said spokesman Sgt Tim Johnson.

A curious chihuahua caught the actions of the couple, who will not be identified by authorities

The department refused to release the identity of the woman or details about her relationship with the officer. It was unclear when the photos were taken, but Garcia said he believed it was either late July or early August.

If Lopez contests his firing, the appeal goes to a special commission within the New Mexico state police department and then state District Court, according to the New Mexican.

Lopez was named a 2009 state police office of the year and was awarded a 'Challenge Coin' in July, an honour given to officers who have gone above and beyond the call of duty.

the stupid lazy fuckwits at the daily mail didn't bother to check. the photo is NOT the NM Officer who was fired, BErt Lopez.

the photo is this Florida Deputy BUrt Lopez who was killed in the line of duty in 2009. this is not an honest mistake. this is lazy, poor, inexcusable and libelous reporting. i have written to the daily mail and to the Sheriff who lost this officer to gunfire.

i HOPE you can rest in Peace Hero Deputy Burt Lopez.

Okaloosa County Sheriff's Office, Florida

End of Watch: Saturday, April 25, 2009 age 44
Deputy Burt Lopez and Deputy Skip York were shot and killed while attempting to arrest a domestic violence suspect.

The deputies were following up on a domestic assault report they had taken hours earlier, and located the suspect at a gun club in Crestview. The suspect was in the parking lot standing next to his truck. Deputy Lopez and Deputy York approached the suspect, had a brief conversation with him, and then informed him he was going to be arrested. As the deputies moved to handcuff the him, he became uncooperative and began to resist arrest. Deputy York fired his Taser (conducted energy device) and hit the suspect. The suspect dropped to the ground during the five-second jolt of electricity. When the Taser cycle ended, the suspect immediately drew a concealed handgun and opened fire. Deputy Lopez was able to radio for assistance while he and Deputy York engaged the suspect in a gun battle.

During the exchange of gunfire, Deputy Lopez was mortally wounded. The suspect then climbed in his truck to escape. Deputy York pulled the passenger-side door open and jumped inside in an effort to pull the suspect from the vehicle, but was shot and mortally wounded.

The suspect fled the scene and opened fire at deputies from the Walton County Sheriff's Department during a vehicle pursuit. The suspect's vehicle was rammed by deputies, causing it to flip over near the intersection of U.S. Highway 331 and U.S. 90 in DeFuniak Springs. The suspect exited the truck, and opened fire at the deputies, who returned fire, killing the suspect.

Deputies York and Lopez were airlifted to Sacred Heart Hospital in Pensacola. They succumbed to their injuries later in the day.

Deputy Lopez had served with the Okaloosa County Sheriff's Office for six years. He is survived by his wife and children and is buried in Heritage Gardens Cemetery, Niceville, Okaloosa County, Florida.

Keep in mind you're dealing with the UK, they have no liable concerns unless our justice department picks this up, and I'm pretty sure holder could give a rats ass.

i know a lawsuit would likely be futile Dick, but i want to shame them and make them apologize. and maybe Deputy Burt's family/estate/Sheriff would go after them, i hope so. i do not consider it an honest mistake, and other big publications are successfully sued.

Christ, i wonder if it's in a print edition??

Maybe send the story to a rival newspaper in the UK so they can give the Daily Mail a ration of shit. Shame is better than money sometimes.

If the fallen officer's family ever reads this: Sorry for your loss. Society can't repay the debt we owe you for giving him to us, but many of us are grateful. I promise to stop flashing my lights at oncoming traffic when I see a speed trap. Smiley_emoticons_smile

I think the best you are going to get from the Mail is a miniscule apology printed somewhere not very prominent.

The editor in chief of the Mail is Paul Dacre and he is on the same level as George W.Bush as truly not giving a fuck.

Murdoch is on a whole different level for cuntishness but Paul Dacre is legendary for being a complete prick to work for and a complete prick in general.

His rages at work colleagues are often reported, he never takes responsibility for any failings or mistakes the Daily Mail has or makes.

You do realize that a british rag not fit for a birdacge cannot be shamed right? That requires a concience which they have surgically removed.
That said, Good On You LC for taking up the fight. There is no excuse for that kind of bullshit
