DA plans no charges in case of body buried in Novato yard

Dale Smith was reported missing by a neighbor in February.

Prosecutors have insufficient evidence to file charges in the case of a Novato man whose body was buried in his backyard, the district attorney said Tuesday.

The body of Dale Aaron Smith, 74, was exhumed from his yard at 4 Rebecca Way after his wife Evelyn, through her lawyer, suggested where police could find the body. He had been missing for several months.

An autopsy showed no signs of violent injury, but the body was so decomposed that the coroner's office could not pinpoint a cause of death. Homicide could not be ruled out, the coroner's office said.

Evelyn Smith, 56, never provided an explanation for how her husband's body got buried, instead leaving it to authorities to find the answers. Novato police and county prosecutors launched an extensive investigation into the potential homicide angle and the couple's financial affairs.

On Tuesday, District Attorney Ed Berberian said there was insufficient evidence to pursue charges against Smith or anyone else, including a misdemeanor charge of improper disposal of remains.

I would think there would be some charges. Disposal of a body inproperly or something.

they'll charge her with something, they have the circumstantial evidence for SS fraud as User suggested. assuming she cashed his checks.
