I do understand Dickly. She got into the garage to leave. Forgot her keys. She should have run to the neighbors instead of going back into the house and shooting him. Or shooting the wall as she did. If she had shot him, she would have to deal with the consequences of that. If she had called 911, HE would have to deal with the consequences of abusing her.

I agree she should of left and called 911. Maybe she went back into the house for the kids. She could of been afraid he would hurt the kids. I guess it's pretty stupid to fire a gun with kids around though.

A Texas man says he was justified in killing an elementary school teacher over a noise complaint because he was “standing my ground.”

Retired firefighter Raul Rodriguez is hoping that a video that he taped himself will prove that he was acting in self-defense when he gunned down P.E. teacher Kelly Danaher outside the victim’s home near Houston in May 2010.

On the video that was presented as evidence in court on Wednesday, loud music can be heard as Rodriguez tells Danaher to “turn it down.”


“You need to stop right there,” Rodriguez says. “Don’t come any closer please. I’m telling you, I’m telling you, stop, I said stop right now or I will shoot you! … I fear for my life. I told you to stop, my life’s in danger, you got weapons on you, stay away from me.”

While standing in Danaher’s driveway with a flashlight and a gun, Rodriguez is also on the phone with a 911 dispatcher using the buzzwords he learned in concealed weapons class, according to the prosecutor.

At one point, one the men Rodriguez confronted suggests that he will get his own gun: “When I go in that house and come back, don’t think I won’t be equal to you, baby.”

“I’m talking to you, and I mean, I’m scared to death here,” Rodriguez explains to the dispatcher. “It’s about to get out of hand, sir. Please help me, now. I’m standing my ground here.”

I agree. I hope the law agrees too. I hate it when these bastards find and exploit the nuances in the laws. It just shows you can't legislate the idiots. Some asshole(s) will twist it to their advantage and fuck up the whole intent of the law.

It makes me think we should have fewer laws and just judge each situation on a case-by-case basis.

This was bad....and a prime example of stand your ground laws gone all wrong. Jesus Fucking Christ. It's basically a license to get up in someone's face, for anything, and if they decide to respond with physical force, you're licensed to shoot them. What a fucking travesty.

Rodriguez could have walked out of Danaher's driveway at any point. he was not trapped. or being pursued.
this is almost like it was premeditated.

I wonder what happened right at the moment someone started laughing and then he fired the weapon. That might be a critical point in the trial... but I think the other critical point is when Rodriguez stated he wasn't going to back down or let them get away with it. That statement likely negates any stand your ground defense, because he at that point was making a decision to continue when his life was not in danger.
