MURDERED: 8 yr old Leila Fowler - 12 yr old brother charged

Here's what I think:

The oldest boy and girl are children from Barney's first wife or Crystal's first husband. I suspect the former. I don't think they are Priscilla Rodriguez's bio kids (but not 100% certain).

The cute brother with the long hair and hands on face at the vigil could be Priscilla and Barney's, or an unknown mother's and Barney's, or Crystal's from a previous relationship - not likely Crystal's though, imo.

Crystal said at the first presser that she wanted to be referred to as "Leila's mom". In every statement that I've seen from her, she refers to all the children as "her's", though not all of them are biologically.

P.s. There was supposed to be a second half of Priscilla's interview aired last week. The first half is the one that I posted upthread; it was the night before the arrest and the very first time that she had spoken in public. The second half went "poof". I think she may have a whole lot to say soon.

911 CALL - WHAT THE HECK IS GOING DOWN? TAKE 2

I've listened to that 911 call several times. Here's what I now think was going down:

1. Crystal says there are two children in the home, older son and daughter.

2. She says they are 12 and 9 (Leila's 8, just a mistake).

3. The older daughter is not in the house; she's with her boyfriend, Crystal, Barney and some other family members at the ball game or headed home.

4. The 12 year old suspect had called the cell phone of his dad/stepmom/older sister (not sure which) and told them that "they" saw an intruder running from the house. (Edited for accuracy)

5. The older sister and her boyfriend continue talking to the suspect on one cell phone while Crystal calls 911 from another one.

6. 12 year old suspect tells older sister and boyfriend that Leila's freaking out and screaming (or they hear Leila) and that he's in the bathroom; Crystal conveys this to dispatcher.

7. Dispatcher tells Crystal that they're going to check it out; Crystal tells boyfriend to get off the phone; police are on top of it.

8. 911/Police calls the Fowler home and speak with the 12 year old.
NOTE: LE ANNOUNCED TODAY THAT THEY WON'T BE RELEASING THIS CALL. DAMN, THIS CALL MATTERS A LOT IN FITTING THE PIECES TOGETHER.

What the 12 year old told police over the phone, whether the Fowlers arrived to the home before the patrolmen, whether Leila died at the house or later, etc...unknown.

CHARGES FILED TODAY - 2ND DEGREE MURDER

2nd Degree Murder - California - Defined:
California state laws list a number of special circumstances that qualify a homicide as first degree murder. The circumstances of first degree murder include a killing committed during the commission of one of the felonies specified by state law or the use of a designated means of killing such as a weapon of mass destruction or an explosive device. All homicides that do not meet the definition of first degree murder will be charged as second degree murder unless the prosecutor chooses to pursue a charge of manslaughter.

The boy, who has not been identified because he is a minor, was charged today with 2nd degree murder with special circumstances for using a dangerous weapon in the crime, ABC station KGO-TV in San Francisco reported. HOTD: We've heard a lot about knives in this case; no details about the "special circumstances" provided yet.

Mark Reichel and Steve Plesser, attorneys from a firm hired by the boy's family to represent him, told ABC's Sacramento affiliate KXTV that they met with him today at a juvenile detention facility. HOTD: Lawyered up quickly; lots of reports in news stories' comments that locals who donated to the family early on are demanding their money back, they don't want to be contributing to the private defense of the alleged killer.

"He's actually doing very well right now," Plesser said. "As well as can be expected in these really difficult times."

The two attorneys said they plan to ask the court to allow the boy to return to his family. HOTD: This ain't gonna happen. Looks good to make such a statement, as if the family would welcome him back (whether it's true or not), knowing imo that the judge will
deny the request.

Yeah, the one looking straight ahead, blank stare, is the 12 year old brother/suspect.

The kid actually looks like he has Autism, or a disability. The expressions are completely blank and creepy. I would assume if he had a disability he would NOT be in a jail, he would be in an institution?

If it turns out that the stories about previous threats and LE being called to the house for "issues" related to the suspect are true, I don't think it would be a stretch to see neglect charges filed either.

I'm still not convinced there aren't possible charges being considered for the parents (and maybe the lying neighbor) in relation to impeding an investigation. JMO - nothing substantiated by LE.

My impression is that Priscilla Rodriguez had been estranged from her children for quite some time. Don't know what all was involved in the "bitter custody dispute" she mentioned in her interview, but a mother can't be denied access to her children legally without good reason. Imo, she didn't know the recent nature of the relationship between Leila and the 12 year old.

I haven't heard anything about him having a diagnosed disability, LytoMe. But, not a lot has been officially released about the suspect or anyone else in the family.

If he's got no record of mental illness, now that he's got private lawyers, bet they're pushing for evaluations straight outta the gate though.

Based on Monday's statement from Barney Fowler (that he won't believe his son is the killer until he sees proof) and yesterday's statement from the suspect's attorney, I'm not getting the impression that the 12 year old has confessed to the murder, but possibly that he's admitted to lying about chasing an intruder out of the house. If he's guilty, he may simply be very cold and crafty.

Attorney's statement:
Earlier Tuesday, Reichel (defense attorney) told The Associated Press that the youngster might have lied about seeing a long-haired man fleeing the scene, but that doesn't make the boy the killer. He said his client might have made up a "macho" story about scaring away the intruder because he was scared.

After reading all the articles on this case, IMO the neighbor might have seen the boy running from the home. This would tie into the boy getting rid of evidence, why they would look in the lake, etc. The neighbor might have said "someone" ran from the home. NOT the description the boy gave. Media always gets things crossed like this.

The "parents" and I say this loosely, have a part. I have no doubt in my mind, they knew or know something. CURIOUS how they are paying for counsel. I want to know more information about the family, DV cases, Department of Family Service involvement?

Looking forward to seeing how this case unfolds.

I agree, this kid with the blank stare and the lack of emotion shows obvious signs of being mentally off.

So many kids in this YOUNG family, geez. He looks scary in the photos, even when his father is hugging him...still NOTHING in his eyes! Creepy
