Police have had access to his phone records since then and he hasn't been charged with anything. I don't know the status of the investigation.

Personally, I doubt it.
LAPD has photos leading up to the crash, and a surveillance video of the crash from an MT bus that was on the same road.
I think if there was photo/video/phone record evidence that Jenner was primping or texting, it would have resulted in charges of negligent driving already. I suspect LAPD is trying to determine if there's evidence that Jenner was following too closely. We'll see.
Anyway, whether he's ultimately charged with criminal wrong-doing or not, I won't be surprised if the family of the deceased files a hefty civil suit.

I didn't weigh in on which of the two issues is more important. I never gave him any grief for bringing up the accident, and, in fact, have commented on the accident several times myself.
I called MS a dipshit for posting that I said Jenner wasn't texting when I never said that. I think he would have been charged by now if he was (at least charged with texting while driving). But, I don't have access to the investigation so I don't know if there's evidence that he was texting or not and never claimed otherwise. That's what I clarified for MS, mocking him in the process.
