The immunity is for the Board of Lucas County Commissioners, and their agents. There is some code preventing use of 911 tapes and the prosecutor is asking that immunity be given to the keepers of the tapes. That's all.

Ohio does not consider audible 911 tapes not public record???? Why would a political entity need immunity for such information?

Calls to 911 are public records. The media has access to them. Not sure why the need to ask for immunity for public officials. But the judge granted immunity and the prosecutor will present the tapes as evidence against Pettaway.

May have something to do with the victim refusing to testify? None of it makes sense to me, just hoping that Pettaway is held to answer for beating on this stoopid twat. The hospital records should seal the deal.

Pretrial Inspection and Request for Immunity

Lt. Twinnings TPD has been ordered to produce said objects for pretrial.

Here is the MEMORANDUM abbreviated.

All telephone calls made to Lucas County 911 in response to emergency situations are tape recorded by the agency. These tapes are then maintained by the agency in the regular course of the business. Ohio Revised Code Section 4931 49(E) states.

No person shall disclose or use, for any purpose other than for the 9-1-1 system, any information contained in the data base of the phone network.

So various Ohio Revised codes are in place here and if they are violated you can be fined 300 dollars or imprisoned up to 90 days thats the first offense for each subsequent offense, such a person is guilty of a felony of the third degree.

Therefor, compliance with the current request could subject the Board of County Commissioners of Lucas County and their agents and employees, Lt. Brian Twinnings, and employees of Toledo Police Department Communications to criminal sanctions.

So everyone from the Commissioners, their agents and employees, Lt. Brian Twinnings and the employees of TPD Communications Section be granted immunity. Further, that the immunity hereby sought be extended to any employee of the TPD Communications Section who is subpoenaed and testifies concerning the material sought by the request.

Gosh I hope this helps a little.

Can a lawyer just remove themselves? I didn't think they could I tout they had to go to the courts and prove why they wanted to and have good reason once they have taken on the case? But if the client fires them that is or would be something different and the courts would give him more time to find an attorney. Either way I would think if the courts agreed to remove the attorney or if he fired the attorney I would think the courts would give him time. I just hope this doesn't continue, become a pattern and become a stall tatitic. How many times can you get a new attorney for your case?

An attorney can motion a court to be removed from a case. The final word on why he/she can or cannot will be with the Judge. The attorney would have to have a really good reason as to why.

A defendant has a right to terminate the services of an attorney.

However, if it becomes apparent that this is holding up court proceedings or delaying the case; the Judge can stop this type of "game playing" by a defendant. The case will proceed with whatever attorney or court appointed attorney is on the case. Of course, I am sure this could go to the appellate level if the defendant loses. I am sure a good judge on a case would make sure that the defendant gets the most out of his defense.


***I hope that detectives and prosecutors have not given up on the Clarke/Straub homicide. It would be great if someone is not giving up after only one conviction. The dismissal is so disgusting on the pettaway side of the case. I still do not understand that, and LC was perplexed by it as well.
