So far, his defense attorney, the (in)famous Mark Geragos, doesn't appear to be advising Smollett to settle rather than go to civil court (based on his public statements).
Instead, Geragos is claiming that the Chicago PD owes Smollett an apology for publicly disparaging 'innocent' Jussie. Geragos says he'll depose Chicago Mayor Rahm Emmanuel and Police Superintendent Eddie Johnson and will demand the "entire investigation file" in civil court proceedings.
In related news, yesterday Cook County State's Attorney Kim Foxx requested the state's Inspector General to review her office's handling of the case. She claims it was handled in accordance with protocol. There's a lot of emotion, ego, and politics from the city officials involved in the case.
