Of course even if there was no original intention to encounter JC & LS and torture and murder them, not only the perpetrators but anyone in on the planning of what might have been intended as a simple entry and robbery faces the possibility of conviction for first degree murder, because proof of premeditation is not required for first degree where the killing is incident to the commission of a felony.
