DAs frequently consult with the family of a murder victim regarding doing a plea bargain versus going for the more severe charge. DAs have taken the death penalty off the table at the request of families of murder victims.
This case was so horrific that, IMO, there would be a public outcry if the DA didn't go for the death penalty - unless it was at the request of the victims' families.
If Johnny's family is screaming for the DP and the Straubs are against the DP and want LWOP, it will be interesting to see what happens.
