interesting. so this reveals that they expect a conviction and hope to keep him off death row because his mommy failed at potty training. 
mitigation is only utilized during penalty/sentencing phase.
or they are going to plead and they need mitigation for pre-sentencing report.
if they plead to keep him off death row, he'll get LWOP.
