in Cornell's definition (Fed. Rules) it is related to the failure to disclose/provide discovery. here:

in this case it also appears to be the fact that state claims defense has not provided a witness list, but 2 witnesses' information may not be disclosed at this juncture.
witnesses names CAN be protected pretrial.
