Legally it has nothing to do with committing the crime, just that Pettaway is too retarded to deserve the death penalty. A mitigating circumstance. I guess he was special ed. And all this retard stuff has to start before 11 years old to matter, I think. I bet he has quite the juvenile record. Conduct disorder is hardly indicative of being retarded.
