Adub: So what is really going on here? I'm not sure except that the defense is sure trying to get the death penalty off the table. They have been from early on. And it seems to be their main objective. Which I find puzzling because what the defense has reported is a mitigating circumstance. Has nothing to do with guilt or innocence. It should be part of the sentencing phase, I would think.

exactly. the defense knows enough that they are looking ahead to the penalty/sentencing phase.
a defense lawyer's job in some death penalty cases is well done if they can keep their client out of the death chamber. sometimes that is the most that can be hoped for.
