Of course you can. You can say anything you want.
LE hasn't charged the Clarkes or Ramirez with attempted murder, and we haven't seen or heard about the evidence surrounding the shooting. So, there's no confirmation available to the public as to whether the investigation points to the trio plotting to shoot at Tiffany in order to scare her, to hurt her, or to kill her.
As I posted initially upthread, I'd think attempted murder charges were in order based on the first reports of the shooting, personally. But, since I haven't seen the communications between the Clarkes and Ramirez, and since I understand that those communications may point to an intent other than murder, I'm not insisting that John being a bad shot is why Tiffany is alive. I think that's very possibly the case and, if so, the charges will be upped. But, it's not the only possibility.
I hope we hear more about what the investigation has uncovered at tomorrow's pre-trial hearing.
