Jonathan A. Ferrell, 24, shot to death by on-duty police officer. RIP.

Randall Kerrick, police officer - arrested for voluntary manslaughter.

Ferrell was involved in a serious car wreck in Charlotte, NC in September. He kicked the window out of his car, climbed out of the mangled vehicle, and traveled barefoot up the embankment to the nearest home for help and banged on the door.

The female resident shut the door and called 911. Ferrell waited outside the house for approximately 20 minutes - when Charlotte PD arrived.

Ferrell was then shot at 12 times by one of three officers on the scene, Randall Kerrick. Ten of the bullets hit Ferrell - he died at the scene.

Today - four months after the killing:
A Charlotte NC Grand Jury failed to indict Kerrick on voluntary manslaughter and asked the Attorney General (Roy Cooper) to resubmit the case with a lesser charge. The Attorney General issued a statement that it was not a full Grand Jury panel that had heard the case and that he would resubmit the case to a full panel as soon as possible; he did not say whether he would resubmit the same charges or lesser charges.

Meanwhile, last week, Jonathan Ferrell's family filed a lawsuit against Kerrick and the Chief of Police. The lawsuit says that Kerrick used excessive force. The family said the city of Charlotte and the police department failed to ensure its officers are adequately trained and instructed in the use of force (Ferrell's family is not claiming that race played a role, though much of the media is still doing so in its coverage).

Ferrell's family and their attorney issued a statement today expressing disappointment in not being kept up to date by the Attorney General and the prosecutors' failure to get an indictment despite having a dash cam showing Kerrick shooting at the confused and clearly unarmed Ferrell 12 times - ultimately killing the engineering student who worked multiple jobs and had no criminal record.

This is really disappointing, to me. I hope that Ferrell's family eventually gets some justice.

Its a disgrace the comic strip world of Judge Dredd is becoming a reality.

Police officers ARE acting as judge, jury and executioner.

And at least Judge Dredd only shoots guilty criminals not law abiding citizens who have just been in a car accident.

Good news today.

The prosecutors resubmitted the case, without amending the charge, to a full panel Grand Jury and received the indictment of Kerrick for voluntary manslaughter.

Kerrick's lawyers are contending that it was improper for the prosecution to resubmit the case after the first Grand Jury failed to indict on the same charges; the law says that a Grand Jury can be comprised of between 12 and 18 panelists. The first Grand Jury presumably fell somewhere in between in number and the one today had a full 18.

Kerrick's lawyers also contend that the prosecutor's public statements about not reducing charges could have influenced the next Grand Jury.

Honestly, I don't know for sure if the arguments of Kerrick's lawyers hold any merit, but from following other cases, I think resubmitting a case to another Grand Jury is neither considered improper nor illegal. I think the defense is grasping at straws and was really counting on a lesser charge being submitted.

I'm happy for the family of Jonathan Ferrell today.

The car's owner, ^ 48-year-old Willie Noble, owns a gun. He saw the kids in the process of the prank, or the act of vandalism, and they ran away and jumped into their car as Noble fired rounds at them.

The group fled to a gas station and called authorities. Adrian, who'd been shot in the head, was rushed to Children's Hospital and died shortly thereafter.

Stupid teenaged crap - egging and toilet papering - it's been going on forever and I get being irritated if your property is targeted.

But, shooting at a bunch of kids over it is surely not "justified" by any law. Let's hope Noble doesn't claim that he saw what he thought was a gun in the car or heard them maybe say, over blaring music, that they were gonna kill him.

Noble has been charged with first degree murder, one count of a terroristic act and five counts of aggravated assault.

I don't give the bird anymore. I had someone chase me down almost 30 years ago. Scared the shit out of me. I usually just yell to myself in my car, or give them the WTF stare if I pass them.

Noble says he was only "shooting to scare".

Lieutenant Sidney Allen said this was all the result of a prank that happened three months ago.

Police said in a news release Tuesday that Noble told investigators he saw his car was vandalized and waited for the teens. He fired when they came back.

"Apparently Mr. Noble's teenage son had done a prank on some of the kids that were inside the vehicle on Halloween Night. As a result they were doing a retaliation prank and it ultimately had deadly results," Allen explained.

Noble has been charged with first-degree murder, one count of terroristic acts, and five counts of aggravated assault.

In addition to Broadway and the 18-year-old driver, one 17-year-old, four 15 year-olds, and one 14-year-old were in the car at the time of the shooting.

EUHARLEE, Ga. – An attorney representing the family of a 17-year-old Georgia boy who was shot and killed by a police officer says the boy was holding a video game controller when he was shot after opening his door.

Christopher Roupe was fatally shot in the chest Friday, Feb. 14 when Euharlee officers showed up at the door of his mobile home to serve a probation violation warrant for the boy’s father.

A female officer reportedly told the Georgia Bureau of Investigation that Roupe pointed a gun at her after he opened the door. But the family’s attorney, Cole Law, said the boy was holding a Nintendo Wii video game controller, and was about to watch a movie.

“The eyewitnesses on the scene clearly state that he had a Wii controller in his hand. He heard a knock at the door. He asked who it was, there was no response so he opened the door and upon opening the door he was immediately shot in the chest,” Law told WSB.

Neighbors who were on the scene just after the shooting believe that Roupe was holding a toy or a controller and say the female officer was visibly shaken and sobbing.

Officials did not disclose if a weapon was found on the scene. The case has been turned over the Georgia Bureau of Investigation.

Roupe was an ROTC student at Woodland High School in Cartersville and his family said he planned to join the Marines. A funeral has been scheduled for Friday.

"It's a difficult burden to meet," Franklin said. "You have to be able to prove what was in their mind at the time of the act. All the circumstances here could lead one to reasonably believe that Mr. Hendrix was acting in self-defense."

The outcome brought no solace to Westbrook's family. "I'm a little upset," said Deanne Westbrook, the slain man's widow. "...I really wanted to see it go before a grand jury, and then maybe before a jury. But they tell me there's not enough evidence for that."

The shooting was preceded by a series of chance events, even a missed opportunity.

About a week before Westbrook was shot to death, Hendrix's fiancee called the cops on a man who came to her door with a paper and a flashlight looking for someone who apparently used to live there. She sent him off, but it made her nervous. She called 911 and called Hendrix, who got a gun and headed for the house, but the man was gone when Hendrix and police arrived that time. IMO, Hendrix probably mistakenly assumed Westbrook was that same guy (who'd also committed not one damned crime).

Earlier in the evening that Westbrook was killed, a resident had called LE to report a confused man roaming around with a flashlight. An officer followed up and talked to Westbrook who told him that he just lived up the driveway. Apparently the cop left (the story is vague on the details of that encounter).
