KELSEY BERRETH, CO -- MISSING/PRESUMED DEAD

I've been loosely following this case for the last couple of weeks and was hoping Kelsey had just taken off somewhere, though it never seemed likely.

^ Kelsey, a 29-year-old pilot and flight instructor, has been missing since Thanksgiving. 

She was spotted on surveillance video with her 1-year-old daughter at a Safeway in Woodland Park that day and her cell phone pinged about 800 miles away in Idaho on Nov. 25.  Her phone has not yet been recovered by police.

Kelsey's fiance, Patrick Frazee - 32, told investigators that he'd seen Kelsey later on Thanksgiving day when he picked up their daughter.

Last weekend, authorities searched Frazee's property in Florissant, but they did not find any signs of the missing woman. At that time, they said they had not ruled out Frazee as a suspect.

Since then, LE received new information which appeared to implicate Frazee and led them to believe that Kelsey was killed in her own home.

Last night, investigators from the Colorado Bureau of Investigation (CBI), the Woodland Park Police Department and the FBI returned to Kelsey's home once again to look for new leads/evidence. 

This morning, LE sources said that the investigation “unfolded rapidly in the last 48 hours, and police no longer believe Kelsey is alive.”

Investigators arrested Patrick Frazee ^ shortly after 7 a.m. this morning.  Frazee was arrested on an investigation of first-degree murder charge and a solicitation of first-degree murder charge.

The solicitation charge could indicate the possibility of others’ involvement in Kelsey Berreth’s disappearance.  

According to court documents, Frazee is being held without bond at the Teller County Jail.

The couple's 1-year-old daughter, who was in Frazee's custody, is safe, De Young said. She is in protective custody and will be reunited with Kelsey's family, he said.

De Young said to expect law enforcement in the area throughout the coming days and weeks. Things are changing hourly, he said, and he didn't want to speculate about where Kelsey's body may be.

“Our work is just beginning,” he said.

Some corrections/updates:

1.  It doesn't appear that Patrick Frazee had primary custody of the little girl (I edited that out of the post upthread).  Based on more recent news reports, it appears that Kelsey and Frazee shared custody.

2.  Frazee's mother, with whom he lives, was detained in connection with the case.  She has not been charged with a crime.

3.  Frazee told detectives early on that Kelsey dropped the baby off at his house after she was captured on surveillance video with the baby on Thanksgiving day.  Investigators now believe that he actually went to her house, where they suspect that she was killed, and took the baby.

4.  The couple were scheduled to attend a court custody hearing on December 27th.

5.  On November 25th, someone sent a text to Kelsey's employer from her phone saying that she was taking the week off.  LE traced pings from her phone to a location in Idaho (but they still haven't located the phone).

6.  It was Kelsey's mom who reported her missing.

7.  Kelsey's cousin describes her as a really good person who made everyone feel good and was thrilled to become a mom.  The cousin says that Kelsey met Frazee on an internet dating site and that he showed up at her home in Washington a few months later to move her near him in Colorado (though the couple never lived together).

I suspect that Kelsey was planning to leave Frazee and take the baby, or maybe he just wanted full custody of the girl. Speculation only.

Frazee has been assigned a public defender and is being held without bond.  His next court hearing is set for December 31.

Court docs revealed yesterday show that LE believes Patrick Frazee was plotting to kill the mother of his child for 3 months.

Based on the wording, it appears he solicited other people to do his dirty work after his fiancee bought the above-pictured house  for herself and their daughter about 15 miles from where Frazee lived with his mom.

Frazee didn't report Kelsey missing, even though he had the baby for 3 days without hearing from her, which was highly unusual.  That was a very early red flag for investigators.

Fortunately, Kelsey's mom (pictured left) now has custody of the little girl.

LE still hasn't located Kelsey's body. :(

This news will likely surprise just about nobody.

Snip:
Two individuals who have worked with the Idaho woman that is being investigated for disposing of Kelsey Berreth's cell phone say that she and Patrick Frazee had been in a romantic relationship for months.

The 32-year-old nurse is believed to have possibly disposed of Berreth's phone in Idaho in the days after she was last seen alive.

The woman, whose identity is not being revealed as she has not yet been charged with a crime, could also be the person who had been plotting with Frazee about killing Berreth should the investigation prove she did in fact dispose of the cell.

DailyMail.com spoke with two people who know the nurse professionally, and they both said that they had been told that Frazee was having an affair with the woman for quite some time.

The woman was divorced from her husband a few years back, they explained, and had met Frazee at a rodeo.

One of the the people DailyMail.com spoke with also said that the nurse was in Colorado around Thanksgiving. 
That would explain how Frazee was able to get the cell phone to Idaho while never leaving the state.

Custody

In my opinion, Kelsey was likely killed because Frazee and/or his mother wanted full custody of the baby and Kelsey would never give her up. 

Now, the little girl is again the subject of a custody battle.

The court awarded Kelsey's mom, Cheryl (^ right), temporary custody after Frazee was arrested and charged with Kelsey's murder.

However, Frazee's mother, Sheila (^ right), has filed a petition with the court to serve as the baby's parent.

I sure hope the judge awards custody to Kelsey's parents.

On Sunday, DATELINE NBC featured Kelsey's story and revealed a lot of new details.

LE believes............

--Patrick Frazee blindfolded Kelsey at her home, asking her to guess the aroma of some candles he brought her.  

--Then, he beat her to death with their baby daughter in the other room, loaded Kelsey into a plastic bin, and took off with her body and their baby.  

--Frazee burned Kelsey's body and the murder weapon (baseball bat) and dumped the ashes at a landfill.

Patrick Frazee had been having an affair with this woman, 32-year-old Krystal Kenney Lee.  Lee was a rodeo queen, a nurse, and a mother of two.  She is the prosecution's key witness.
 
Lee told investigators that Frazee had attempted to get her to kill Kelsey on three separate occasions, but she didn't go through with it and Frazee finally did it himself.

Frazee called Lee right after he murdered Kelsey on Thanksgiving and directed her to drive from Idaho and clean up the mess in Kelsey's condo, which she did.  Lee also took Kelsey's phone and sent texts to Frazee and Kelsey's employer to make it look like Kelsey broke up with Frazee and just took off.

Lee says Frazee had convinced her that Kelsey was abusing their baby.  Frazee's employer/friend said Frazee told him Kelsey would sometimes go missing and go to alcohol rehab.  Both of those stories about Kelsey are baseless.

Anyway, Krystal Kenney Lee got a deal for cooperating with prosecutors.  She pleaded guilty to one count of tampering with evidence.  Some members of Kelsey's family are pissed about that because Lee had so many opportunities to tell police Frazee was plotting to kill Kelsey and she helped him after-the-fact.

It's understandably very frustrating for the family and the police, no doubt.  

Without Krystal Kenney Lee, however, prosecutors wouldn't likely have a case against Frazee that would hold up in court (no murder weapon, no body, no eyewitnesses, no forensics evidence tied to Frazee....).  

So, they had to entice Lee to tell the whole sordid story about a man she loved and to testify against him in court.  Lee's a piece of shit even if she believed Kelsey was abusive, in my opinion.  But, it's better for her to get off relatively lightly and be shamed for life than to have Patrick Frazee living freely with custody of the little girl.

I agree with this and I certainly do understand why they did what they did as far as the leniency goes. It's just so sad, I feel for Kelsey's family and I get irate sometimes because doing the right thing shouldn't be a difficult decision to make.

It really is sad.  The prosecutors have to deal with the lesser of two evils.

But, Krystal Kenney Lee will have to live with what she did (and didn't do), and everybody knowing about it, for the rest of her life.  Good.

And, I'll be very surprised if Patrick Frazee and his defense attorneys don't try to blame the murder on her.  She's definitely gonna be torn apart under cross examination.
