Local story here over the last couple of weeks. I'm interested in your opinion, LC (and others, but this should hit close to home for LC)

Personally, I think the felony charges are a bit harsh....but at the same time, a detective should be the first person to know how to properly keep a firearm in a secure place. As it stands, I'm sure she feels completely awful about the incident, as would any adult that made the same mistake.

And holy shit.. when you first look at her picture...didnt you honestly think it was a guy? Holy bull-dyke batman!

she DOES look rather masculine.

i have to agree she was dead wrong, criminally negligent and liable, in leaving a loaded duty weapon where a kid could get it. no equivocation. when she came home to little kids in the house, that gun should have been placed out of any possible reach, magazine popped out and chamber cleared. or trigger lock applied. and yes i know a cop's weapon should always be ready to rock and roll, but there were special considerations here, ie, 2 curious toddlers. there are laws in many jurisdictions that cover this situation, and she was not immune from the law if it applied there. or even the law of common sense. people who leave loaded weapons where kids can reach them are PROSECUTED and rightly so. she was no rookie either.
i have known cops who have shot themselves while cleaning an "unloaded" gun, or even fooling around with one. we had a young rookie on my dept. blow his own brains out at his 21st birthday party, in front of his horrified friends...showing off his new toy.

Agreed she is criminally negligent.. but a felony? I'm sure it's a statute thing.. but it seems they're being a bit more harsh due to her status as an officer. Or, perhaps they just don't want any lesbo's on the force of the hick-town of Emmett, ID

Edit: Also I can't figure out why the children's mother would be charged in this... it wasnt her gun ???? Should she be held liable for the negligence of another? I guess perhaps if she had noticed the weapon on the nightstand prior to the indecent, and did nothing to secure it...

But at the same time, both my current, and ex wives wanted absolutely nothing to do with coming close to my guns.. they wont even touch them....

the mother was responsible for her kids' welfare and safety, and had a duty to protect them from the danger of a loaded weapon. as an adult in the home, she is complicit. her charges may be reduced since she didn't have ownership/control, but because a child suffered a GS wound, maybe not.
it's a felony because someone was actually shot. 2 people in fact. you can research the applicable statute. Smiley_emoticons_biggrin
they aren't prosecuting BECAUSE she was a cop, but i can promise you the judge (if it comes to that and isn't pleaded out) will jump in her shit about it!

I guess my confusion is, that several times a year, in my neck of the woods, you get stories about folks being shot while some asshat is cleaning a weapon, or accidentally drops one..whatever...there are countless types of accidental discharges. But yet, most often..there are never any charges placed, and yet all are technically "negligent". For some reason, they really seem to be taking a tough stand on this one...perhaps because of the combo of kids being hurt, and the fact that of all people, this wench should have known better.

if the dumbass shoots him/herself the DA probably doesn't want to be arsed with prosecuting. but in this case, it was a little child. not the dumbass owner. i think the key here is that innocent bystanders were wounded and it could have been a lot worse.

The key here is that a trained police officer allowed her weapon to be taken control of by someone else.

Rule number one, never willingly give up your weapon.

Now that rule is an internal matter, would the officer have been charged the same if her weapon was taken from her and it was used to shoot 2 people? the answer is no, does it matter that it was kids that took the weapon from her? the answer is yes, the law that is being used to prosecute the officer is a child protection law which makes it criminal to leave a weapon where a child can get a hold of it even if the weapon was not fired and the situation came to light she could still be charged under that statute the fact that it was fired and it injured someone else makes it an aggravated charge of the same statute.

BATTLE GROUND, Wash. -- A sheriff's deputy's 3-year-old son accidentally shot himself in the head late Tuesday night at a Battle Ground home, police said.

Battle Ground police and Clark County firefighters found the injured boy when they were called to the home at about 10 p.m. Paramedics then rushed the child to Legacy Emanuel Hospital in north Portland, where his condition has not been released.

The boy's father, a Clark County sheriff's deputy, was off-duty and at home when the shooting happened, officers said.

It wasn't immediately clear how the boy got access to the gun. While emergency dispatchers said the gun was a service weapon, the Battle Ground Police Department hasn't confirmed that detail.

A joint investigation by three police agencies is under way.

The Clark County Sheriff's Office has a policy that requires officers to lock up their service weapons when not in use. The sheriff's office also supplied deputies with lock boxes.

The policy was adopted after a 13-year-old boy shot and killed his 10-year-old sister with a gun issued to their father, Clark County sheriff's Sgt. Craig Randall, in January 2003.



The Sheriff's Office is no stranger to tragedy, and took significant steps to ensure that appropriate firearms storage policies and procedures are in place following the very tragic death of Emily Randall in 2003.
The Sheriff's Office firearms storage policy recognizes the Constitutional right of citizens to keep and maintain firearms. Policy mandates the safe storage of department issued weapons, and encourages employees to use safe storage techniques for any personally owned firearms as well.
The Sheriff's Office identifies acceptable safe storage techniques including the use of gun safes, gun lockers, trigger locks and cables, locked gun cases, vehicle mounted locking devices and other locked containers when a firearm is not in the employees' immediate possession.
The Sheriff's Office provides employees who are issued department weapons a locking gun safe, for use in their residence.

NICEVILLE, Fla. -- A Florida Panhandle deputy is recovering after accidentally shooting himself.

The Okaloosa County Sheriff's Office said Sgt. Donald Lee Savage was cleaning his police-issued firearm on Wednesday at his Niceville home when the weapon fired.

Savage was struck in the knee and taken to Twin Cities Hospital.

Maj. Graham Fountain said Savage was in good condition and that it appears to have been an accidental shooting.

FRANKLIN COUNTY, IN (FOX19) - The 4-year-old son of a Franklin County, Indiana Sheriff's Deputy has died after he was accidentally shot in the stomach by a gun he and his twin brother found in the basement of their home.

Aiden Mehlbauer died Wednesday evening at about 6:30 p.m. at Children's Hospital after being shot in the stomach earlier in the afternoon.

The Batesville Police Department received a 911 call just after 4 p.m. that a shooting had occurred at 20140 Stacy Road.

Aiden's mother told police that Aiden his twin brother, Mason, were in the basement while the mother helped their 6-year-old sister with her homework.

In the basement of the home there is an "office" area currently under construction in which the boys' father, Greg Mehlbauer, a Franklin County Sheriff's deputy, has stored his uniforms and other law enforcement equipment.

In that area, the twins located a loaded 40-caliber Glock semi automatic handgun. The boys were handling the gun when it discharged.

I was gonna update this thread myself, the cop in the OP pleaded guilty to felony injury to a child (under a plea agreement) just last week, she's probably end up with just 2 years probation. Sentencing in March.

Doesn't seem to harsh to me. I think she was rightly held to a longer yard stick than a lot of the "accidental " shootings you hear about when someone gets hurt. She is supposed to be a trained professional whos job it is to protect people, however, she left a weapon out for toddlers to get to.
