A rape support group has reacted with fury after a judge in Nebraska threatened to send an alleged sexual assault victim to jail if she doesn't testify.
Victim advocates said the decision could backfire and discourage other women from reporting rape and sexual assault.
The 24-year-old woman, from Kansas, is appealing against the contempt order, saying that testifying about the sexual abuse she endured as a child would cause her deep humiliation.
In his ruling, Lancaster County District Judge Paul Merritt said the charges against her alleged attacker hinge on the woman's testimony.
But president and founder of the Rape, Abuse And Incest National Network (RAINN), Scott Berkowitz, said the judge's actions will make the criminal justice system even more daunting to rape victims who are already reluctant to report assaults.
Mr Berkowitz said: 'It's very rare for a judge to hold a victim in contempt and it's counter-productive.'

My opinion:
This gal has the duty to testify...simple as that, as if nothing else, it could prevent this perverted fuckstick from doing this to another child. However, there's no way in hell she should be facing the possibility of a contempt charge/jail time. She should realize that there is no shame, nor could anyone with a sane mind possibly look down on her because she was molested as a child. While she may not want to re-live the terrible things that happened to her as an 8 year old, she simply has to realize that this asshat needs to be convicted, and most importantly, she can potentially stop this from happening again.

This person should be able to testify from a back room by closed circuit TV or by tape, this is a ploy used by the defense to bring shame to the victims of abuse in an attempt to keep them from testifying.
Personally I would like to see her be proud enough to walk in and spit in the face of man who did this to her, but some people do not have the stomach for things like that and the court needs to take a different position.
Public out cry could help her, she needs to go public with this stuff in a big way.

That's what I thought too...the courtroom could be sealed at the judges direction...along with corresponding testimony/public court records that include the name of the victim.
Edit: Seems like they were able to do something very similar with the gal that was held as a kidnap victim by that perverted couple just a year or so ago (Cant remember the gals name, but she was kidnapped at a bus stop as a young girl and held captive for over a decade). I think her name was released, but she was able to keep her face private until she decided to go public)

She should be able to give testimony from behind a screen or via closed circuit/webcam.
Children get this sort of protection in the courts and I don't see why people who were abused as children shouldn't also get it if it's what they want.

Why is that Duchess? Perhaps I could understand the fear a gal might have in not wanting to relive a terrible part of her life...but why would a gal not want to see a perpretrator of a crime against her not get what's coming to him? Why would a person feel shame about something that happened to them as a young child that they had no control over?
I guess it's somewhat similar to the boys that got molested by the priests....being ashamed to admit what happened, but to me, that's a bit different.

I can only guess because I've never been in that position but telling a room full of strangers about being violated in the worst way possible for a female would be a horror of humiliation. Many women don't even report rapes because of the humiliation aspect. First they are raped, then they are forced to undergo an exam gathering evidence of the rape & then they are forced to recount the rape over & over again. It must be exceedingly difficult.

I can understand the stress of reliving a horrific event in the courtroom, but if something like that were to happen to me, I'd either want to take care of "justice" myself (1st choice), or make damned sure the courts did. Either way, I don't think that I'd feel shame over something which I had no control over as a youngin.

It may help you to have a better understanding if you are able to imagine your daughter in that scenario. I don't say that meanly but simply in a manner that maybe you could relate to as a father & watching your daughter take all the steps needed to see it through to the end.

Ask your daughter how she would regard going through all of that. Ask your wife how she would feel watching her daughter go through it. Would your wife insist your daughter endure it if daughter didn't want to?

Yes, I would insist. Simple as that. I'd also insist that the judge use any/every privacy controls he/she has at his/her discretion to keep my kids identity a secret.
Keep in mind though, we're talking about a gal that's now 24 years old....not a recently molested minor. This gal should be able to clearly see the potential ramifications of not testifying.
