Home owner forecloses on bank

After refusing to pay its legal fees, a Bank of America branch in Florida was foreclosed upon. Due to careless investigation, the bank wrongfully foreclosed on Warren and Maureen Nyerges who had paid cash for their home. The couple took Bank of America to court wherein the judge ruled that the bank had wrongfully foreclosed on the homeowners. As a result, the bank was under obligation to pay the Nyergers’ legal fees.

For five months the bank ignored the homeowners’ calls and letters, and the couple took the next legal step. The Nyerges’ attorney, Todd Allen, directed two Sherriff’s deputies and a moving company to take possession of the banks’ furniture. Allen instructed that all the banks’ assets be seized: computers, desks, and cash in the tellers’ drawers.

After an hour of being locked out of the bank, the bank manager finally wrote a check for the Nyergers’ legal fees. Bank of America also offered an apology saying, “We apologize to Mr. Nyerges that there was a delay in receiving the funds. The original request went to an outside attorney who is no longer in business.”
