DUI checkpoint
I think checkpoints are a blatant infringement on our rights, even though they've been upheld in the courts.
Can you tell me why the officers didnt pursue this any harder?

Anyhoo, heres what it is if you still dont want to watch it. It's a DUI checkpoint. Guy gets stopped and obviously has video running. Officer asks him if he's "had anything to drink tonight". Dude says nothing...and I mean nothing. Officer calls for his supervisor. Dude then asks for the officers name and badge #, but nothing else. Officer gives dude name and badge #, and again asks if he's had anything to drink....dead silence. Officers supervisor comes over and the whole scene is repeated with her. At the end, after the dude says absolutely nothing when he's asked questions, he asks if he's "free to go" a couple of times" the supervisor finally tells him "you can have a nice day", and he leaves.
Now, I'm wondering if this was so because of the fine line officers have to walk due to unreasonable search and seizure laws that officers have to operate under during these check points, or perhaps since the dude appeared sober, and they perhaps didnt smell any alcohol that they figured the dude was not DUI material, or a combonation of the two.
Edit: It almost seems that the only initial question an officer is allowed to ask someone during a checkpoint was if the driver had been drinking. Is that the case, LC ?

well, i have said i didn't do traffic, and things change all the time out there. but since a checkpoint is not based on probable cause to stop the driver, that's likely the case. with no outward signs of impairment, the driver has an absolute right not to incriminate him/herself.
