Hate to say this, but all of these guys live real close to me ! Makes me sick. We have lived in our very nice home since 1959 and raised 8 kids here. I could throw a stone and hit one of the houses.

Toledo Blade 12/7/2012 Fifth subject above Deitrekk D Boone sought in slaying of CrossFit Gym owner Joe Lengel.

Sergeant Heffernan said and Mr. Boone should be considered dangerous.

Anyone who sees him or has information on his whereabouts is asked to call Crime Stoppers at 419-255-1111.

BLADE STAFF WRITER.

The last suspect in a band of five, all charged with some role in the robbery and shooting death of a local gym owner, continues to elude Toledo police.

Deitrekk Boone, 19, of 1416 Beecham St., charged with aggravated murder and aggravated robbery, was not in custody Thursday night.

Mr. Boone and four other Toledo men are accused of having varying roles in the robbery and death of Joseph Lengel, Jr., 57, who owned Intensity CrossFit Gym in South Toledo.

Held in the Lucas County jail on Thursday, charged with aggravated murder and aggravated robbery, were Devonte Harris, 19, of 1326 Gordon St., and Jason Kuhns, 31, also of the Beecham address.

During a Thursday morning appearance in Toledo Municipal Court, each was ordered to be held in the jail in lieu of $1.5 million bond.

Also held in the jail in lieu of $500,000 bond on a charge of aggravated robbery was Matthew Managhan, 34, of 1156 South Ave.

Chad D. Brown, 35, of 839 Walbridge Ave. was arrested Thursday afternoon on a charge of aggravated robbery; he will appear in court today.

During a news conference Thursday, police Sgt. Joe Heffernan said, “Mr. Lengel appears to have been an innocent victim in this.”

It does not appear, police said, that any of the suspects knew Mr. Lengel. Police declined to say why the suspects were drawn to the remote location, 757 Warehouse Rd., the morning Mr. Lengel was killed, other than to say the men had planned a robbery.

“They felt there was obviously going to be some type of payoff from doing this robbery, and it didn’t turn out the way they planned,” Sergeant Heffernan said.

Toledo police Capt. Wes Bombrys said investigators know what was taken from Mr. Lengel, though they declined to elaborate.

Mr. Lengel arrived at his gym early on Nov. 19. Police said he was approached by three men — Mr. Kuhns, Mr. Boone, and Mr. Harris — two of them armed with guns, and robbed by the trio.

“We believe he resisted the robbery, and during the course of the robbery, he was shot and killed,” Captain Bombrys said.

A gym patron, who dialed 911, found Mr. Lengel’s body at 5:56 a.m. Mr. Lengel was pronounced dead at the University of Toledo Medical Center, the former Medical College of Ohio.

An autopsy showed that Mr. Lengel was shot once, with a shotgun, in the left side of his chest.

Police declined to say who they suspect was the shooter.

A surveillance camera at the Warehouse Road plaza captured at least some part of the crime, though police declined to say what or whom the footage showed.

“It [the video] was helpful,” Sergeant Heffernan said.

Police said investigators are still trying to determine how the suspects are acquainted.

The men all have addresses in the same South Toledo neighborhood, near the site of the former Libbey High School; two of the suspects share an address, according to court records.

Other than a Facebook friendship between Mr. Davis and Mr. Boone, no conclusive relationships have been drawn.

Court documents allege that Mr. Brown and Mr. Managhan “did organize, plan, and participate in the aggravated robbery of the victim.”

“We have a pretty clear picture of how it went down and how it came about,” Captain Bombrys said, declining to explain.

Captain Bombrys said Mr. Brown and Mr. Managhan were not at the crime scene that morning.

A Toledo police incident report states that, on Nov. 27, at 8:30 p.m., a team of police searched a North Toledo home to which Mr. Brown has some affiliation.

Police searched 344 E. Streicher St. looking for evidence related to the slaying,

According to the incident report, no one was home when police arrived; officers reported that they entered through an unlocked front door.

From the home, police took a bag filled with tools and a book bag with a “game box” inside, according to the report.

The report does not indicate how long officers were inside the home.

When a reporter went to the house last week, no one answered the door, although a light was on in a front room. Neighbors either declined knowing anyone who lived there or denied witnessing the search.

At least two other homes were searched during the investigation, police said.

Police reported searching the Gordon Street residence Wednesday, confiscating an unspecified type of ammunition. Police also searched 3417 Anderson Pkwy., an address associated with Mr. Managhan.

It was not clear whether anything was taken.

Police declined to discuss any of the seized evidence or anything found at the scene.

“It was really a case of good old-fashioned police work,” Sergeant Heffernan said. “There was some evidence we were able to recover; one thing led to another.”

Police do not anticipate any additional suspects — though the investigation is ongoing — and said more charges could be filed.

Sergeant Heffernan said and Mr. Boone should be considered dangerous.

Is this still in the preliminary stages? Or has the prosecution made a stance in regards to a life/death penalty trial?

Yes to your first question SC. As far as I can determine no stance on life/death penalty trial yet.

They have all been charged with Aggravated Murder and Aggravated Robbery. All 4 of them pleading "not guilty". Boone the 5th one is still on the run .

ABC 13 WTVG was granted permission to report on trial.

Looks like The Hon. Judge James Bates has been assigned.

No date yet when trial starts.

Update from Toledo News Now January 11 2013

U.S. Marshals join TPD in search for gym owner murder suspect.

TOLEDO, OH (Toledo News Now) -
Toledo police still have their sights set on a suspect they say is responsible for the murder of a Toledo gym owner back in November.

It has been nearly two months since Joe Lengel was gunned down outside of his gym, Crossfit Intensity. Although police have arrested four men they say had a hand in the robbery that ended in murder, they are still searching for one more: Deitrekk Boone.

Police say Lengel showed up to his gym to open for the first class of the day, when he was robbed and shot to death.

Police arrested and charged Jason Kuhns, Devonte Harris, Chad Brown and Matthew Managhan in connection with the crime, which is the first step for getting justice for Lengel's family.

According to police, they have a better chance of speeding up the process with the public's help.

"We have a very good success rate at capturing people, and I'm sure that Mr. Boone will be captured here shortly, too. It's just a matter of somebody knowing where he is, letting us know and we'll do the rest from there," explained Sgt. Joe Heffernan with the Toledo Police Department.

The U.S. Marshals have now joined the search for Boone. Anyone who has information on his whereabouts can call CrimeStopper at 419-255-1111. Tipsters can remain anonymous and reward money is available.

Thanks for the update on this Older Than Dirt, what a shock to find out Mr. Lengel was the wrong person. It's a terribly sad story! Glad Matthew Managhan, plead guilty.

Deitrekk Boone is still on the run.

Just found out to-day the following information taken from The Norwalk Reflector May 15th 2013.

Two men sentenced for murder of gym owner in ill-fated scheme.

Widow: “I once am again reminded of the death of my husband, my best friend, my protector, my soul mate."

In handing down life sentences Tuesday for two men involved in the robbery and murder of a South Toledo gym owner, Lucas County Common Pleas Judge James Bates said the scheme was an ill-fated one.

“I hate to use the expression you might have been ‘the brains’ behind this particular robbery because I don’t think there was a lot of brains being utilized — selecting the wrong person that was supposed to be robbed, then murdering the person as a result of the robbery — 2 co-defendants but you kind of organized it,” he told Jason Kuhns. “You were there. Two other people actually physically accosted the victim. Both of them had guns. You knew they had guns, and the foreseeability of someone being killed was quite evident.”

Kuhns, 32, of 1416 Beecham St. pleaded guilty April 23 to murder in the Nov. 19 shooting death of Joseph Lengel, Jr., 57, outside CrossFit Intensity Gym in South Toledo. Judge Bates said Kuhns would be eligible for parole after serving 15 years in prison.

Judge Bates also sentenced Devonte Harris, 19, of 1326 Gordon St. to life in prison with eligibility for parole after 25 years.

Harris, who pleaded guilty April 26 to aggravated murder in the case, responded “no” when asked whether he wished to make a statement.

His attorney, Donald Cameron, reminded the court that his client was much younger than the other men involved in the foiled robbery.

He said Harris was not involved in the planning, and that it was “more of a spontaneous thing” for him that went way beyond what Harris ever could have imagined.

Kuhns told the court he was “deeply sorry,” adding, “I regret not being able to stop them.”

Diana Lengel told the court she and her late husband would have celebrated their first wedding anniversary Tuesday.

Instead, she said, “I once am again reminded of the death of my husband, my best friend, my protector, my soul mate. Joe’s family — his children, grandchildren, and friends — are also mourning the loss of this wonderful, strong, but kind and gentle man.”

Already in prison are two co-defendants who helped plan the attack: Matthew Managhan, 34, of 3417 Anderson Pkwy. and Chad D. Brown, 35, of 839 Walbridge Ave.

Each was sentenced April 30 to 15 years in prison after pleading guilty to aggravated robbery and involuntary manslaughter in the commission of felonious assault with a gun specification.

The fifth suspect in the case — Deitrekk Boone, 19, of 1416 Beecham St. — remains at large. Investigators say he took part in the robbery armed with a handgun.

Judge Bates said after sentencing Harris that while it was not his practice to do so, he felt compelled to recognize Toledo police for conducting a “remarkable investigation.”

“Had a number of things not occurred, had a different detective been assigned to this case, it potentially could have gone unsolved,” the judge said. “My compliments to the Toledo Police Department for their investigation as it relates to this case.”

Thanks for the update, NightOwl.

Good of Judge Bates to recognize the work of the detectives on this case.

So, if I understand correctly, 4 of the 5 suspects have been convicted and are serving time already, either life sentences or 15 years. Glad they're caged.

Where the heck is Boone? That guy's managed to escape apprehension for months on end. Hope he's caught soon.
