Ah, yes, the school teacher. Even the judge is fucked up. He made a comment to the effect that the girl's personality is why she killed herself, not because she was raped.

A former Montana high school teacher who has served a 30-day prison sentence for the rape of a teenage student was released from prison on Thursday morning – as the victim’s mother said the teacher is “still skating” justice.

Stacey Rambold left prison after serving the sentence imposed last month for the rape of student Cherice Moralez six years ago, said Judy Beck, a spokeswoman for the Montana Department of Corrections. The 14-year-old Moralez committed suicide in 2010, and her mother Auliea Hanlon has said that she believes the rape was a contributing factor.

Along with activist groups and the Billings School superintendent, Hanlon has protested what she feels is an inadequate sentence for Rambold’s actions. The teacher, 54, pleaded guilty in April to a count of sexual intercourse without consent.

One of the comments from the judge -

Baugh said at the time that the confusion “could have been avoided altogether if I’d been more alert or if the state had pointed out to the court the correct mandatory minimum,” according to NBC News station KULR in Billings.

Jesus Christ.
What an asshole of a judge. He is trying to blame it on the prosecutor, a little common sense would have seemed to indicate a much longer sentence

He raped that girl, she later committed suicide and the judge in part gave the guy that non-sentence because the girl "looked older" or some such shit.

There was no justice here. He wasn't even in jail (or in the proper jail) long enough where he was forced to take it up the ass a few times. I don't know what the typical rape sentence is but that fucker belongs behind bars for at least a few years. 30 days....pfft.
I think 30 days is a joke as well.

But, I don't think Cherice's suicide should have been a consideration in determining the sentencing. He didn't kill her or have any expectation that she'd kill herself years later. I don't know her mental and emotional state before her sexual encounters with the asshole Rambold; only know what her understandably devastated mother feels about it.

At 14, Cherice wasn't legally able to consent - it's statutory rape and that's what he pleaded guilty to. From what I've read, there's no contention that Cherice was physically forced or spending time with Rambold unwillingly. It's still rape and still deserves some jail time, IMO - especially considering that he didn't complete the sex offenders program which was part of his probation agreement.

Debra Lafave pleaded guilty to having a sexual relationship with her 14 year old male student. Her sentence was very similar to Rambold's: no jail time, house arrest & probation, an offender's program, registration as a sex offender, no unsupervised/unreported contact with minors... If her victim commits suicide next year, it won't change her (too light, IMO) sentence.

And then there are other teachers who have had the book thrown at them in similar situations.

I'd like to see a standard minimum of 3 years for statutory rape, for example, for adults (regardless of gender) in positions of authority who engage in sex with minors (regardless of gender) under their charters - no matter what the circumstances. Maybe, that would serve as a deterrent. Maybe. I see stories in the crime news about male and female teachers having sex with their students every week. Perhaps psychological screening in the hiring process could help keep cradle-robbers out of schools, churches, etc... in the first place. IDK.
I know somebody who is serving 15 years for statutory rape.

I agree that the suicide shouldn't be factored in but that 3 year minimum sounds reasonable.

I think this is the young woman whose attorney said she was too pretty for prison. 78
