"There is a plethora of evidence being uncovered," Nurmi told the court. Stephens did not immediately rule on the motion, and a hearing is expected to be held at a later date.

HEY, WHERE'S THE PORN? -- accusations and motions between the Defense and the State delay trial testimony

Day 13 of Jodi Arias Penalty Re-Trial

Testimony in the sentencing retrial of Jodi Arias takes the day off today, but attorneys will be in court for a hearing to address a defense motion to have Arias' murder conviction thrown out.

They claim images of pornography on murder victim Travis Alexander's computer were destroyed while in Mesa police custody.


And in another twist, prosecutor Juan Martinez has filed a motion to have sanctions against Arias' attorneys.

The motion claims that one of the defense team's expert witnesses damaged a laptop computer that could be a key piece of evidence in the case.

The defense witness was expected to testify that he found thousands of pornographic images on Alexander's computer.

However, the prosecution's motion alleges that the computer was damaged so that the state's computer expert could not re-examine it.

The motion also claims that Arias' attorneys handed over computer files that belonged, "to an individual named Tony," that had nothing to do with the case.

As for a defense motion to throw the murder conviction out, the hearing Friday will discuss the thousands of pornographic images the defense claims were deleted from Alexander's computer while in the custody of Mesa police.

This is a fairly odd update, as I heard on local news last week that the judge was denying the motion to dismiss because the defense tampered with the laptop in question.

The judge likely delayed (not denied) the motion hearing last week to give Martinez time to file his counter motion (asking for sanctions against the defense attorneys for the alleged laptop disabling). The news guy mighta just got the wording wrong in his report.

The defense's motion to dismiss is being heard in court today.

P.s. I wonder if Tony is pissed that his porn got plucked. Smiley_emoticons_wink

ANOTHER MOTION TO DISMISS THE DEATH PENALTY

An appeals judge overturned Judge Stephens' order to close the court to the public for witness testimony in the penalty retrial. Media sources had protested Stephens' decision and won. Media persons still can't televise or stream the retrial, but they can attend and report on the proceedings.

So...........the media is back in the courtroom for witness testimony.

But...........the witnesses are refusing to testify because they are reportedly afraid that they'll be identified and harassed, threatened or harmed.

Therefore....Jodi contends that she can't get a fair re-trial and wants the DP taken off the table.

The three witnesses in question haven't been publicly identified, but defense attorneys have described them as a longtime Arias boyfriend, one of her former co-workers, and a person who was a friend of Alexander before he met Arias.

Will this bitch's fate really be sealed by end of year? Man, I hope so.

I resent that she has all this time. I might go batshit crazy if I hear she's singing Christmas carols and enjoying a holiday experience like I've seen her do behind bars. The fact it's in the slammer means nothing to me. I don't want her to have the pleasure of enjoyment. I don't want anything lovely for her no matter how small it is. She doesn't deserve it. She doesn't deserve the air that she breathes.

It's weird because normally we see this in men. I watch the crime shows and even see how 'normal' people become evil and do evil. But this woman is, psycho evil crazy and not in a psychiatric way, it's like a demon possessed off the planet bat. That is really who she is. No doubt Travis saw it before he died. Poor man.

Well, the retrial almost certainly won't be wrapped up by end of 2014 now.

Melissa Lenette Garcia (pictured above) was Juror #3, one of 12 citizens who would decide if Jodi Arias should die, but now she’s a defendant in her own criminal case.

She was charged with writing bad checks just after Thanksgiving and has been booted from the jury. The trial has been delayed, again, for at least a week.

Another delay. Jesus. So I guess it's completely unrealistic to expect an alternate to simply slide right into her place and the proceedings start right back up without any loss of time. This passed ridiculous awhile ago.
