A profound post as Martinez had the courtroom sit for almost two minutes in silence to prove that it wasn't a quick or fast kill.

Genius!

It seemed like an eternity.

Seeing Arias attempting to come across as so affected and devastated about the pain that she inflicted upon Travis is like watching bad satire.

She literally butchered him and left him lying dead and naked in the shower, then attempted to cover her tracks, took a nice little road trip, went on a date...

She was cruel alright. Before, during and after the murder. Still today, as evident by her slanderous false accusations against Travis throughout the trial and in her post-verdict interview.

Gawd I hope she ends up in isolation on death row. General population for life is too good for her, imo.

Nah. I'm pretty sure I have a gallbladder but I've never noticed it.

It's in the jury's hands, now.

Next is the sentencing phase.

Expect victim impact statements here.

How long do you all think it will take the jury to come to a verdict?

I think that the jury is going to find that there were aggravating factors; extreme cruelty.

The crime scene and autopsy photos alone would convince me. Glad Martinez showed them to the jury at every single opportunity.

GUILTY of extreme cruelty, so says the jury.

Arias is now eligible to be sentenced to death.

If she truly wants the death penalty we shouldn't expect any character witnesses for Jodi, right?

Okay this might be another mindless question that i might be asking here but will jodi be speaking tomorrow? HLN speaker just said she can't get up there and say i'm sorry for committing a premeditated murder etc... i didn't even think about it/her getting up there and speaking before the jury. If that does happen, is her statement pre-approved? or is she asked questions? i've never seen this part of the process so i'm flying blind i guess.

I'm recording the proceedings as i have an appointment tomorrow at 8 am and don't know how long it will take and the doctor is always running behind no matter what time the appointment is. i hope that i don't miss anything good and that hln doesn't hit that pause button too much but just let's the proceedings go through.

I think Jodi could speak at some point in the mitigation process but were she to suddenly express remorse, I heard it might not play well for her in an appeal. So, I don't know if they'll put her up there unless she's trying to get herself killed.

I believe they're starting with victim impact statements tomorrow.

RE: The Jodi Arias Trial--Fatal Attraction – The Murder of Travis Alexander - BlueTiki - 05-15-2013

Mitigation phase will include at least one expert and all of the friends and family of Arias Nurmi wants to parade in front of the jurors.

Victims' Impact Statements come in at this time, too.

And "Yes." Slasher bitch has an opportunity to address the court.

Expect the performance of a lifetime!

I'm wondering if she will apologize?

RE: The Jodi Arias Trial--Fatal Attraction – The Murder of Travis Alexander - HairOfTheDog - 05-15-2013

Heartbreaker:

I think for the penalty phase which starts tomorrow, the sequence is as follows:

1. Victim impact statements

2. Pleas for leniency/mercy from Arias's side, including Jodi if she wishes (she may choose not to express remorse, even if she actually felt any, because that could hurt her in appeals)

3. Jury sentencing deliberations

I don't believe they are subject to cross-examination.

ETA: Sorry Tiki, posting at the same time...

RE: The Jodi Arias Trial--Fatal Attraction – The Murder of Travis Alexander - heartbreaker6713 - 05-15-2013

This is what i found about the cross examination when i googled it. It doesn't say that it isn't allowed when there is a judge present. And i have a vague memory of some session on tv that if it got to this point that martinez would put the interview of jodi's parents. of course that was speculation because no one knows what martinez is going to do until he does it and we see it. anyways see below for what i found and the link provided.

Some states have strengthened victims' rights to make victim impact statements. In Oklahoma, for example, the governor signed legislation amending and expanding the law concerning victim impact statements (Senate Bill No. 665). The legislation protects victims' absolute right to make a victim impact statement and prohibits anyone other than the victim from amending or excluding the statement from the record. The law also prohibits the cross-examination of victims presenting oral impact statements when the cross-examination is not part of a proceeding before a judge or jury acting as a finder of fact.

RE: The Jodi Arias Trial--Fatal Attraction – The Murder of Travis Alexander - HairOfTheDog - 05-15-2013

I was wrong about the sequence of tomorrow's penalty phase.

Here's what's on the schedule for Thursday, 5/16.

After the defense and then the prosecution finish opening statements:

Up First: The Prosecution

(I think this is where Martinez may use Arias's post-verdict interview)
Alexander's family members may take the stand for the prosecution to give victim impact statements. The family's statements will likely be emotional as they describe their loss.

Up Second: The Defense
The sentencing phase is the defense’s opportunity to ask the jury for leniency and present evidence supporting why Arias should be spared from the death penalty. Witnesses may include Arias’ friends and family. Arias could also make a statement to the jury pleading for her life to be spared.

Followed by: Closing Arguments
Defense Closing Arguments
Prosecution Closing arguments
The defense has a chance for rebuttal

And Lastly:
The jury deliberates for a third time to determine whether Arias should be sentenced to life or death. Their decision must be unanimous. In the case of a deadlock, a mistrial would be granted and a new jury would be chosen for this phase only.
