I don't think anyone should be above the law. At the same time mental compitence is always a factor. Depends on the degree I guess.

I don't have a problem with it as a principal. Might need to be on a case by case. A menace is a menace. Low IQ is no excuse for committing capitol crimes.

If it's gotten to the death penalty phase, the courts have already decided that the criminal was competent to stand trial, which I interpret as:

1. They understood the crime they are charged with, and knew it was wrong

2. They are intelligent enough to understand what is going on in the court room.

Would depend on the level of understanding and cognitive functioning. If the person was cognitively at a 5 year old age level, then they would not have fully understood the consequenses of their actions. In that case, incarceration yes in maybe a locked down mental health unit. If they are of a higher IQ, high enough to get what they were doing was wrong, then yes
