(AP) -- Flying and oral sex don't mix, a judge ruled Tuesday as he upheld the Federal Aviation Administration's decision to revoke the license of a pilot who allowed a busty blonde woman to perform a sex act on him as he flew her around San Diego. [line] The FAA took the action earlier this year after a videotape of the May 29, 2005, encounter surfaced on the Internet. Neither the identity of the videographer or the woman seated next to David Martz was revealed. However, published reports have identified the woman as a Swedish porn star. "The evidence clearly shows grossly reckless conduct on the part of the respondent," National Transportation Safety Board administrative law Judge William R. Mullins said after spending an hour in private reviewing an unedited version of the video with FAA officials, Martz and his lawyer. Mullins said the 52-year-old Martz may have been unable to respond to a flight emergency because his pants were down around his knees and the woman was at times blocking access to the aircraft's controls. During her closing argument, FAA attorney Lierre Green said Martz's actions "could have been disastrous." She noted that Martz's license had been suspended twice before and revoked one other time because of various incidents dating to the mid-1980s. Although he had had no problems since 2005, she said, that didn't absolve him for this incident. Martz, who left the hearing room grim-faced, declined to speak with a reporter. The judge told his lawyer he had two days to appeal his ruling. Martz took the witness stand during the three-hour hearing, testifying that while the incident didn't represent "the brightest thing" he had ever done, he had learned from it and other mistakes and wouldn't do it again. He acknowledged that just a month after his encounter with the woman he had hit a wire as the result of careless flying. "I actually learned my lesson when I hit the wire, when I hit the wire in 2005 in Mexico," he said, his voice breaking. Since then, his lawyer said, he has had no run-ins with the FAA and in 2007 he volunteered several days of his time to help search for doomed aviator Steve Fossett whose plane crashed in the Sierra Nevada. Three fellow pilots who testified on his behalf also said they had noticed a dramatic change in behavior. "I've seen Martz change over the last three years to basically crossing his Ts and dotting his Is," said Tim Sears, a flight instructor. But all three acknowledged that it was irresponsible to do what he did. "Would you fly around and have someone give you oral sex?" Green asked Ruben Campos, a pilot who works for Martz's Socal Helicopters, a La Jolla-based business that provides helicopter tours, photography and other services.
