Dick it has been tested by the Supremes. i'm not posting all that here. google is everyone's friend. 
despite "princiPLES" of the Constitution, i merely pointed out the statute IS on the books, like it or not. there are reasons for it. one cannot advocate violence with impunity. i question the wisdom of doing so in a public forum.
and yes i sure do hope that backwoods "preacher" gets his ass handed to him. by a court of law of course. he is the proximate cause of brutal murders. some "free speech" is neither responsible or legal.
like yelling "fire" in a crowded theater.
