you mean he can't be arrested unless he is guilty? a judge or jury decides that. he can be arrested with sufficient probable cause/evidence and taken into custody at the loony-bin. it is up to the doctors whether/when/if he can be interviewed. his self-admission was an obvious ploy for him to gain time and evade questioning, but he can't stay in there forever. or maybe he can if he is committed for an indefinite period. by a doctor or a court.
also note, his mental illness may not meet the definition of legal insanity.
