Bales is expected to be charged on Thursday. His lawyer contends that the government will have a hard time proving his guilt because there is no forensic evidence and no confession.
Defense Strategy: The lawyer is not going for an insanity plea, but instead will argue diminished capacity. He denies that Bales was drinking, but contends that Bales only remembers the early part of the evening and afterwards; no memory of the incident.
All circumstances surrounding the incident and his deployment are being investigated (good thing). There will be a military criminal investigation and separate administrative review by US Forces Afghanistan.
