Guess at the very least they are going for endangerment and have arrested both parents at their CPS hearing. They have plenty even if the autopsy is still pending to go after the endangerment charges now.

SMITH COUNTY — Parents of 2 year old Jacob Kimbley, who was found dead near his home last Wednesday, have been arrested and indicted on charges of child endangerment.
Sabrina and David Kimbley were arrested during a hearing in a Smith County courtroom on Thursday, August 30th, just before 5:00pm. They are charged with child endangerment.
Officials with Child Protective Services cited "neglectful supervision" of so many children, which resulted in Jacob's death, as the reason for the indictment.
Their five remaining children have been in foster care since the incident, and will stay in foster care during the course of the hearings. KETK has been told that the children are doing fine, and are undergoing medical check ups.
The Kimbley's will not be allowed to visit their children during this time.
KETK has been told there will be several more hearings over the next few months.
