If it went down that the guy purposefully got out of his seat to look up a girls skirt, then it is for another reason; it's for the difference between right and fucking wrong! It's for a deterrent to hopefully stop the sick bastard looking up looking up the next girl's skirt.

If the guy was only ogling somebody for what they wore on public, whatever. But if he goes out of his way to see things that cannot normally be seen, then he deserves anything he gets.
