In California, posting revenge porn is actually illegal now. Governor Brown signed a bill into law and the end of 2013. But, it's only punishable as a misdemeanor with a 6 months max jail sentence and a fine of $1,000. Moore and Bollaert were both charged with felonies as a result of the extortion/blackmail and identity theft charges associated with their revenge porn businesses.
Florida quashed a similar bill on the grounds that posting the images and personal information of those depicted in the photos is covered by free speech; most states reportedly view it the same way. The ACLU also opposes the CA law as a first amendment violation.
