It does seem like a bullshit threat.
It's not a crime to post a picture of minors in public places without parental consent.
It would only be a crime if the photo of the chid was sexual in nature.
Maybe that's the threat the mother is using against the photo poster?
Along the same lines as what you said about the privacy irony, how could she claim the photo is sexually explicit when advocates for public uncovered breastfeeding claim that society wrongly views breasts as sexual. If not for the breast, where's the "sexual" part of the photo? In the photo-taker's mind? I don't think that would fly in court.
I agree with everyone else that the guy who took the photo is a creep. But, it's not a crime to be a creep.
