...and laughed & recorded it. There were five of them, aged 14 - 18 and not one of them did one damn thing to help. I am sickened by this story.
A group of teenagers laughed and watched as a man struggled in the water of a pond. The man drowned, and his body was not found for days.
The five teenagers did nothing to help him, not even call 911, but after examining the video, the authorities said this week that they did not break the law.
The low-quality, 2.5-minute cellphone video was provided to The New York Times by Mr. Archer’s office and earlier obtained by Florida Today. It shows a man flailing in the middle of a body of water as the teenagers describe his struggle and laugh at him from the shore.
One of the teenagers, using an expletive, calls Mr. Dunn a junkie. Someone tells him not to expect any assistance: “Ain’t nobody going to help you, you dumb bitch. You shouldn’t have got in there,” he says.
About a minute into the video, the man appears to let out a whimper before submerging, fully, underwater. “He just died!” a voice can be heard saying, as the others begin to laugh.

That's fucking cold.
I KNEW I had read about people getting prosecuted for not aiding someone but apparently only ten friggin states have a law on the books requiring someone to give aid where feasible:
The 10 states identified by Volokh with "duty to rescue" statutes are California, Florida, Hawaii, Massachusetts, Minnesota, Ohio, Rhode Island, Vermont, Washington and Wisconsin.Nov 3, 2009
California does SOME things right.
Jesus. One of the reasons SOME states started to consider a "Duty to Act" law. However, on the flip side, you might have someone on an airplane having a heart attack and a Dr. on board refusing to assist out of liability concerns. I *think* that has been addressed in what's called Good Samaritan laws. We need a fucking law for every day common sense. Huh, even the duty to rescue laws are very limited. Basically you're only required to call for help if it won't put you over your data limits for the day. Sheesh.
From time to time, national attention is drawn to the issue of a
legal duty to assist those in distress. In 1964, accounts of the murder
of Kitty Genovese on a New York City street horrified the nation.
Over the course of thirty-five interminable minutes, the
young woman was repeatedly stabbed as she cried for help and
crawled toward the door of her apartment building. Thirty-eight of
her neighbors looked on from the safety of their own apartments
above the well-lighted street, but none summoned help. Well after
her attacker had fled, a single caller notified the police, who were
on the scene within two minutes.1 A stunned public learned that
Ms. Genovese's neighbors had violated no law. Legal commentators
called for legislative reform, but within a few years the issue had
faded from view.
I hate legislating common sense but douche bags like those teens make me WISH they faced criminal charges for their inaction.

The kids wouldn't have fucking known about the law. I wonder if the guy said something or did something prior to this incident.
I haven't listened to the video, I read the story and I am amazed that not one of them went for help.

I listened. They basically thought he was a homeless dude, and prior to recording the man actually entered the water on his own, I guess he was despondent and probably loaded. They mock him the whole time and if there was ever a description of "depraved indifference" this is it. The disconnect from human empathy is the world we live in now. These kids are the epitome of America...
Thank god I am oblivious to the opinions of others while caught in the blinding splendor of my own cleverness.
