You know raising a child in this day and age, you have to warn them about sociopaths and weirdos coz they are everywhere these days. It's just part of the parenting regime.

Baby Released from CPS Custody, Returned to Father

CPS has finished testing and positively verified that the baby found in a swing at suspect Magan Fieramusca's residence is in fact Margot Carey, the daughter of Heidi Broussard (whose body was found in the trunk of a vehicle parked outside MF's Houston home).

Margot ^ was released to her father Shane Carey last night while his father Ty Carey was leading a vigil for Heidi.  She's a cutie alright.

(note:  the referenced/linked DailyMail article states that MF was charged with Heidi's murder, but that's inaccurate -- so far, she's only been charged with kidnapping and tampering with a corpse.)

I am glad the baby is safe, but that is so sad for her that her mother is dead. Thanks for that HoTD, I read the whole thing. The mother was surrounded by violence. A violent boyfriend and a predator best friend. Her body would still have been healing after the birth of a child. She would have been in a weakened state and easy to overpower. The child is only 3 weeks old and so still would need support holding it's head as the muscles in the neck are not strong enough at that stage.

I know that the child is now being returned to the father, but what kind of gentleman is he? Grabbing her by the arm, and taking off with the dog? What a psycho that best friend was. I know it can happen over here just like over there in the USA, maybe because you have a bigger population, but some of the weird murder stories that come out of the USA are scary. I see it is in Houston, am wondering if she was a Christian, she probably was as Houston is a big Christian population.

Heidi Broussard and Shane Carey both liked to party and had ups and downs in the course of their rocky 10 year relationship.  That's not contested by anyone, including Shane.

I did see Heidi's texts w/pics to her friend claiming that Shane took their dog, then grabbed her (bruising her arms) when she threatened to leave him.  That's not even in the same ballpark as Nicole Brown Simpson's photos and 911 calls, in my opinion.

Shane Carey has never been charged or convicted of domestic violence (which I wholeheartedly condemn).

And, we don't know the context of Heidi's  (presumed to be private) claims that were released to the public by her friends when they assumed Shane had disappeared Heidi and Margot, which was the most likely scenario statistically speaking.

Shane didn't bother addressing those private claims when they were made public because he was instead busy meeting with LE and imploring them to find Heidi and Margot, making public pleas (albeit disjointedly) for the return of his fiancee and daughter, and driving around with Tim Miller searching for Heidi and Margot.

I personally don't think internet posters owe Shane Carey an apology for considering him the most likely suspect or doubting him; totally justifiable. 

However, I don't think CPS would have released Margot to Shane's custody if they had evidence that he was a violent abuser.  And, I don't think Heidi's mother would be standing by Shane if she wasn't sure that he loved her daughter and their children.

What I mean is, the first person they usually look at is the partner. There is evidence of physical altercation. One thing I learned in sociology "every domestic violence situation is potentially fatal". I don't think he had any part in it at all. There is evidence he is an abuser though, the pictures the texts. Maybe the threshold is higher with CPS.

Regarding the best friend she is just a monster. I dare say if they release her into the main population she will be a target in prison.

Look the whole situation is just so tragic HoTD, it's heartbreaking.

Yeah, it really is tragic and heartbreaking aussie.  I'm with you there.

I don't think it's likely we'll find out any more details about this terrible crime or see more charges filed during the holidays.  MF isn't going anywhere and LE has a lot to investigate.

In the meantime, it's good to see the baby out of CPS custody and Heidi's family united for Christmas.

New Details - Unsealed Affidavit

A nurse at the hospital where Heidi gave birth to Margot reportedly overheard Magen Fieramusca talking to Heidi about being 37 weeks pregnant, the affidavit said. 

The day after Heidi Broussard gave birth, Fieramusca drove from Houston to South Austin to see them, according to the affidavit. 

Broussard and her fiance, Shane Carey, reportedly gave Fieramusca a key to their apartment on Nov. 26. Fieramusca stayed with Heidi's family until Nov. 27th but never apparently returned the key.

On Dec. 8 or 9, Shane Carey reported that he learned Fieramusca delivered a baby girl, but said he did not see any pictures of the baby.

According to the affidavit, a person who lives at the same apartment complex Broussard lived in, had video cameras outside of his residence that captured a vehicle consistent with Fieramuca's car driving at the complex around 9 a.m. on Dec. 12, the same day Heidi Broussard and Margot Carey went missing.

One witness said that on Dec. 11 or 12, she saw an adult white woman at the apartment complex carrying a small baby and walking towards a parked car. 

The witness reportedly told police she then saw another woman exit the car and greet the woman carrying the baby. The two women and baby then entered the car and drove away, according to the affidavit.

On Dec. 19, the witness was presented with a photo lineup which included Fieramusca. Police said the witness was 60% to 70% positive that the woman she saw in the front seat of the vehicle at the apartment complex was Fieramusca.

Upon further investigation, officials found that Fieramusca conducted suspicious internet searches. 

Police said Fieramusca reportedly searched for "reasons for Amber Alert" and "Amber alert issued Austin" on Dec. 12. 

A full review of searches between Nov. 11 and Dec. 18 revealed that some form of "Heidi Broussard" was searched at least 162 times from a device using an account that lists Fieramusca's name.

On Dec. 14, two days after Heidi and Margot went missing, Fieramusca allegedly searched "bodies found in Austin Texas."

According to the affidavit, data from T-Mobile revealed that Fieramusca's phone was in the Austin area near Broussard and Shane Carey's apartment on Dec. 12.

Authorities then began conducting surveillance on the Houston-area home where Fieramusca was living. Officials said they found her car parked in a way that appeared to be an attempt to hide it.

Officials followed the owner of the home and interviewed him, the affidavit said. When they showed him a picture of baby Margot Carey, the man said he thought it was the same baby living at his house.

The man explained to officials that he and Fieramusca had broken up in March and that he had never seen her bare stomach during her pregnancy. 

The man added that he noticed Fieramusca's stomach grew during the year and that he felt her stomach, which he described as hard.

According to the affidavit, the man believed Fieramusca was pregnant with his child. Fieramusca allegedly said that on Dec. 12, she left to go to the beach with a cousin.

When Fieramusca saw the man she was living with on Dec. 13, she told him, "Don't be mad, don't be mad," the affidavit said. That's when Fieramusca reportedly told him there was a baby on the bed.

Fieramusca allegedly said that she went into labor and delivered their baby without the man's knowledge. She reportedly told a Texas Ranger that she went into labor on Dec. 12, but could not remember the name of the birthing center in which she reported giving birth at. 

On Dec. 19, officials searched the home where Fieramusca was living at, according to the affidavit. When investigators arrived, they reportedly smelled the "unmistakable odor of decomposing flesh" emitting from the trunk of a vehicle parked at the house. :(

The body was later reported to be that of Broussard's. According to the affidavit, the body was shoved into a black duffel bag.

"Magen Fieramusca abducted Heidi Broussard by restraining her and preventing her liberation by holding her in a place where she was not likely to be found; specifically inside a black duffel bag in the trunk of a parked vehicle," police said in the affidavit.

Fieramusca is scheduled to appear in court on February 3rd.

I cannot even get into the mindset of that type of mentality. The cops that can do this stuff day after day must have a steel personality. but someone has to do it.

Yeah, the LE members who work these kinds of cases see some terrible shit.

In reading over the Affidavit pages, it’s puzzling to me how Fieramusca’s ex wasn’t alerted by the terrible stench coming from the trunk of her car parked in his driveway. 

But, so far, it doesn’t appear LE suspects him of involvement in the crime.  LE approached him in the parking lot of a Target store where he was buying formula for what he reportedly believed was his days old newborn. 

He confirmed for them that the picture of Margot looked just like his baby and that gave LE what they needed to move on Fieramusca.  Too bad it was too late for Heidi.  We still don’t know where or when she was strangled to death or if Fieramusca definitely acted alone.

It would only take one person to strangle a baby. That's first degree. Anyone else that knew about it would be 2nd degree.

Fortunately, the baby wasn’t strangled.

Baby Margot was found inside the suspect’s residence in a swing. She was physically unharmed and ultimately returned to her father.

The mother, Heidi Broussard, died of strangulation and was found inside a black duffle bag in the trunk of the suspect’s car (which was parked outside the suspect’s residence).

Capital Murder Charges Filed

Yesterday, a grand jury returned a capital murder indictment against Magen Fieramusca alleging that she, on or around Dec. 12, intentionally kidnapped baby Margot Carey and caused the death of Heidi Broussard by asphyxiating her with a leash and her hands.  :(

If convicted, MF could be sentenced to life in prison or the death penalty in Texas.

Shane Carey, Heidi's fiance and Margot's father, told ABC News’ Good Morning America earlier this month that he was in disbelief after Fieramusca was arrested for kidnapping.
