easley arraigned today on abduction charge. not charged with murder yet.

Jeffrey Easley, accused of fleeing Roanoke County with his slain girlfriend's 12-year-old daughter, was brought into court today, where a judge confronted him with the abduction charge.

Easley, 32, unshaven, handcuffed and dressed in an orange jail jumpsuit, was asked by Roanoke County Juvenile and Domestic Relations Judge Philip Trompeter if he needed a court-appointed lawyer.

"Yes Sir," Easley answered in a low voice.

He told the judge he lost his job about six weeks ago and has no income, real estate or car. The judge appointed attorney Thomas Roe Jr., who was at today's hearing at Easley's side.

Easley was returned to Roanoke County on Wednesday from San Francisco, where he was found panhandling outside a supermarket with 12-year-old Brittany Smith.

He was charged with abducting the girl, whose mother, Tina Smith, 41, was found slain Dec. 6 in the home she shared with Easley and Brittany on Fort Lewis Circle. Easley is a suspect in Tina Smith's death, Roanoke County Police Chief Ray Lavinder said.

Commonwealth's Attorney Randy Leach said after today's hearing that there was no timetable for charges in Tina Smith's slaying. He wouldn't say whether anyone else was likely to face charges in the case.

Trompeter's small courtroom was crowded with reporters and Easley's mother, Sallie Martin, and step-father, who live in Franklin County.

The hearing, over in less than 10 minutes, ended with Easley hauled back to Roanoke County-Salem Jail without bail. Trompeter scheduled a preliminary hearing on the abduction charge for Feb. 8.

Roe said he spoke to Easley today for the first time.

"He seemed like he had his wits about him and is concerned about the charges," said Roe. He said he planned to talk with Easley further this weekend.

Easley is being held in isolation, under suicide watch. Neither the lawyer nor police would say why. Roe said Easley asked to be taken off suicide watch.

Easley also was charged in Salem with credit card fraud, for allegedly using Tina Smith's credit card to buy camping gear at the Salem Walmart before he and Brittany headed west.

I know it is a foundation of our criminal justice system, but it angers me that we have to pay for the defense of fucked up people. Of course they are broke, they are fucked up. Nobody wants to pay fucked up people to hang around their businesses and be fucked up for eight hours.

No charges for the 12 year old? She gets a legal pass because of her age? How many 12 year olds would kill their parents if they knew they wouldn't be charged?

The Rev. John Eure doesn't want people to remember Tina Smith for how she died.

"Even though this is part of a story in Tina's life, it is not the whole story of Tina's life," Eure said. "The murder should not define who she was."

The pastor urged about 175 of Smith's family and friends, gathered at Ash Avenue Baptist Church in South Boston on Saturday for Smith's memorial service, to remember the 41-year-old nurse for her quirky ways, her kindness and her service to others.

Smith was found slain at her Roanoke County home Dec. 6. Her boyfriend, Jeffrey Easley, 32, is suspected in her death. He's charged with abducting Smith's 12-year-old daughter, Brittany Smith, and taking her to San Francisco.

Brittany, returned to her family Monday, sat through the service with her father Benjamin Smith and other relatives at her side. Dressed in black, she kept her dark hair curtained around her face and at times wiped away tears.

With what will be a difficult Christmas for Tina Smith's family just a week away, Eure said she was a gift to those who knew her.

"God gave her to us as a gift," he said during the hourlong service. "It was a gift that had a heart of compassion, that had a heart for family."

Smith believed in serving others through the military, as a nurse and a mother, Eure said.

"Perhaps God used something with that to help bring about a miracle that we saw Friday a week ago, when Brittany was found," Eure said. "Perhaps some of those things that [Brittany] learned may have helped her to survive that past week that she was away. I think if Tina knew that, she would be well pleased."

Eure told the grieving friends and family to turn to their relationship with God for healing, and to forgive.

"Forgiveness does not mean forget. I don't know where we get that," Eure said. "But it means we let go. I think forgiveness is a gift from God to help us to let go of the things that hold us down."

Smith's cremated remains were placed in a wooden urn on a table at the front of the church.

A folded American flag, roses and candles surrounded the urn. An array of flowers placed on the altar were set against Christmas wreaths, red poinsettias and angels with trumpets.

Photos of Smith as a baby, a girl with pigtails, and then as a teen and an adult wearing a white nurse's dress, flashed in front of the church from a projector.

One photo showed Smith skydiving in honor of her late son, who accidentally died last year of self-asphyxiation.

Church bells rang out as the processional left the church for burial service at Halifax Memorial Gardens.

South Boston firetrucks and police cars stopped traffic at intersections along the way. Several officers who work with Brittany's father stood outside the stopped cruisers with their hats held over their hearts.

Brittany Smith appeared at a gathering to welcome her back to her hometown of South Boston on Sunday evening. The 12-year-old has been largely sequestered with family since she was found in San Francisco on Dec. 10 with her accused abductor, Jeffrey Easley.

Smith sat with her father, Benjamin Smith, on the stage at a public amphitheater during speeches and a gospel music performance. She chewed gum, sipped hot chocolate, held a lighted candle, smiled often and occasionally waved to people in the crowd of about 50 gathered at Constitution Square.

At the end of the celebration, she stepped up to a microphone.

"I just wanted to thank everybody for all their prayers," she said. The crowd erupted in cheers of "Welcome home Brittany!"

After the event ended, Brittany lingered for about a half hour, exchanging hugs with many of those who came.

I know what you mean. Call me an asshole, but I just keep thinking that there is MUCH more to this story and yes, she is 12-years old but these kids aren't the 12 year olds of our days and this young lady is definitely not your average 12 year old. She is much more mature than your average 12 year old, and again I'm a big ol' meanie but the pics of this kid give me the creeps.

it wasn't prosecuted? i don't know, there was one Nolle Prosequi.

the community who came out sunday to "welcome" Brittany home was only about 50 people i think. they probably mean well and want to show her support blah blah, but i think much of the community is holding back until they see how this shakes down. i know i have not made up my mind about her complicity or lack thereof.

Those who came were invited to make "love offerings" of cards or money. HUH?
