I hate insurance/benefits companies

I am totally tweaked right now. Some who kno0w me know that 3 years ago I had surgery, had to be off work a few months. Got disability benefits, and all was well. After I went back to work, I got another check from them...which I called about...and as far as I remember, returned the check at their request. Hey..its been 3 years, memory sucks and I have no paperwork.
Later in the year, I get a letter from them..we have this check here, that you never cashed...can we send it to you? Oh well...figured I had made a mistake (yeah..THAT was the mistake). Signed and got the check.
NOW..fast forward 3 years and I get a letter from them today...it seems we sent you an extra check..because YOU had requested it and we sent it in good faith. We want our money back..bitch.
Tried calling right away, office closed (at 4:15 in the afternoon, nice). I am sitting here in total meltdown mode..because they want the $300 plus in 10 fricking days. WTF.

Three months ago, I fucked up on the tennis court.

3.2 mile Phoenix Fire Department ambulance ride to a Scottsdale hospital.

Over 8 grand a year in insurance premiums.

Trying to deny my $893 ambulance bill. Three fuckin' point two miles.

What? I shoulda called a limo?

The bitch is...I do not have proof that I sent an uncashed check back to them. But when I call I may have them on one thing...the letter said they sent me a "replacement check" and that I had cashed the original check. I guess I will ask for proof that I cashed two checks....like both checks endorsed by me.
Guess I am glad I have a family lawyer..may be needin g to call him into action. It may be only $300 to some...but it is a lot when you were not expecting having to pay it..and all.

Please tell me they didn't "miny Miranda" you by disclosing this fact, in their letter!

Tiki..they did NOT disclose any rights...and the only "proof" they enclosed was the notice they sent me in 2008 that they had a check that I had not yet cashed...and if I did not claim it they would send it to the NY unclaimed funds dept

Without trying to sound too crass...you cashed a check that wasnt rightfully deserved, even though it may have been their error. Unfortunately, you owe them 3 bills. Look on the bright side, at least the greedy bastards arent trying to charge you interest.

The FDCPA only applies if a third party is attempting to collect a debt. If the insurance company called or sent a letter themselves they do not have to abide by the FDCPA.

True.

Insurance companies use brokers and "agents". There is the possibility that the communication is from a third-party.

This is true on a general level for FDCPA. However, there are provisions of HIPPA Privacy Rule (Standards for Privacy of Individually Identifiable Health Information (“Privacy Rule”), 45 C.F.R. §§ 160 & 164, subpts. A & E) that address medical debt collections.

Furthermore, The FCRA provides procedures for consumers to dispute the completeness or accuracy of information, including delinquent accounts, appearing on their credit reports & further imposes special rules for the reporting of medical debt [FCRA § 623(a)(9), 15 U.S.C. § 1681s-2(a)(9). See also FCRA § 605(a)(6), 15 U.S.C. § 1681c(a)(6)].

Moreover, depending on your state, they may be additional laws and/or protections/rights afforded.
