Hopley charged with breach of probation

Alleged child abductor Randall Hopley has been charged with two counts of breach of probation, but has not been charged in the disappearance of three-year-old Kienan Hebert.

At a press conference Tuesday, B.C. police said that Hopley seemed to have acted alone, and did not have an accomplice as had been reported earlier today.

The breaches allegedly occured last Wednesday, September 7 and on Monday, September 12.

Hopley was caught by police tracking dogs near the B.C./Alberta border this morning.

He was found in the Crowsnest Lake, Alt. area, 20 kilometres from Sparwood, B.C. where Kienan was taken.

Police did not say where Kienan was kept or whether he provided them with any information leading to Hopley's capture.

More charges are expected later.

Police expect he will be charged with kidnapping and abduction of person under the age of 14.

Police received “promising information” that Randall Hopley – accused of abducting three-year-old Kienan Hebert -- was just across the boundary with Alberta, zeroing in on the area Monday night and launching a search early Tuesday morning that flushed the suspect out from an abandoned camp.

Cpl. Dan Moskaluk said Mr. Hopley was arrested at about 10 a.m. Tuesday and his vehicle recovered shortly afterwards.

Mr. Hopley acted alone, Insp. Fitzpatrick. There was no accomplice, he said. There had been an initial report someone else had run from the area of the arrest, but that turned out to be erroneous, Insp. Fitzpatrick said.

He said there was a very low probability of Kienan being dropped off at his own home. Police had patrols out in the area, concentrating on other spots where they thought there was a better chance Kenan might be found, he said.

Insp. Fitzpatrick emphasized there was no deal between the alleged kidnapper and the Hebert family regarding the youngster’s return.

He said the family’s plea that Kienan be returned was “pure and simply an investigative tactic” by police. “It was an idea to appeal to him (the suspected kidnapper) in a belief he may have been monitoring the media.”

“He was pretty quiet,” Mr. Gresl said of the suspect. “He was unshaven, that’s for sure. He wasn’t that big, you know. He was in handcuffs.”

CRANBROOK - Police hustled abduction suspect Randall Hopley into court this morning in Cranbrook, as he pulled his blue shirt over his face in a bid to shield himself from cameras.

Hopley, handcuffed and wearing a blue long-sleeved T-shirt and black pants, arrived in an RCMP SUV as reporters peered through a fence.

Hopley, accused of kidnapping three-year-old Sparwood boy Kienan Hebert, has been ordered to undergo a full psychiatric evaluation.Randall Hopley, now formally charged in the abduction of three-year-old Kienan Hebert last week, will undergo a mental-health assessment to determine whether he is fit to stand trial – and whether he was suffering from a mental disorder that would exempt him from criminal responsibility.

A judge has ordered alleged child abductor Randall Peter Hopley, 46, to undergo a psychiatric assessment to determine if he is fit to stand trial.

Hopley made his first court appearance in Cranbrook, B.C., on Wednesday morning to face charges in the alleged kidnapping of three-year-old Kienan Hebert last week.

He appeared without handcuffs, but with his feet in shackles, unshaven and dressed in a navy T-shirt. He appeared tanned, but not gaunt or with any other appearance suggesting he lacked food during the time he was allegedly on the run from police.

Hopley stood slouched with his hands clasped as the judge ordered him to be held in custody and undergo a psychiatric assessment to determine if he is fit to stand trial.

Hopley didn't look at the full courtroom, only at the judge and his counsel. He is scheduled to appear in court again on Nov. 9. for a bail hearing.

On Tuesday police said they expect Hopley will face charges of kidnapping and abduction of a person under age 14.
Hopley 'has a story to tell,' says lawyer.

Outside the court, Hopley's lawyer William Thorne said Hopley is tired and "sorry for the situation he's in," but glad the little boy is home safe.

"Mr. Hopley has a story to tell. Eventually his story will come out," he said.

Thorne said his client only suffered minor injuries during the arrest on Tuesday, and his greater concern was for Hopley's safety in prison.

Thorne said he was concerned about the possibility that other inmates may try to exact some kind of retribution, and said he wouldn't be surprised if Hopley was on suicide watch.

VANCOUVER — Newly released court documents involving the man accused of kidnapping a B.C. boy reveal a disturbing snapshot of a high-risk sex offender.

Randall Hopley was convicted in 1985 of sexually assaulting a five-year-old boy and a psychiatric report leading up to his prison release says he was at high risk to offend again.

The report says Hopley, then 21 years old, refused sex offender treatment and wasn't a suitable candidate for other treatment programs.

The psychiatrist said Hopley, who had an IQ well below average, was one of those people who seemed to have fallen between the cracks of various support agencies.

In 2008, Hopley was convicted of break and enter in connection to his intention to abduct a 10-year-old boy and the judge said the case was an offence against a young child.

Hopley is undergoing a psychiatric assessment ahead of facing allegations that he abducted three-year-old Kienan Hebert from his bed in Sparwood.
