I've been reading more about this story. I don't like the surrogate, she was a very poor choice, that's just my opinion, she was much too needy. Anyway...she signed the contract agreeing to "abortion in case of severe fetus abnormality." Do any of you disagree that the issues this child has constitutes severe fetus abnormality? The genetic parents had every right to expect the contract to protect their interests.

Go back to what I said about having your spawn out there and thinking that the baby is suffering. I don't know that that's their stance but I could see damages in that.

I haven't finished reading everything I pulled up but with knowing only what I do so far I'm not so sure the surrogate bears any blame for that given it wasn't her egg. The bun was put in the oven, she wasn't the baker.

I think that Crystal was a bad choice as well.
Yes, the severity of the condition constituted severe fetus abnormality in this child. While the parents might have been right in expecting that the contract would protect their legal interests, the fact is that the abortion clause is unenforceable.
I feel badly for this couple if they're truly struggling with this child's suffering, but they exercised their right to walk away from any responsibility to care for the baby. They're back where they started, less $22k. The couple had other options and engaged in an ill-advised situation in attempt to have a fourth child. Imo, they bear some responsibility for their situation too.

Nah, I don't think children with birth defects should have the right to sue their parents for not terminating but I wouldn't be surprised to find out that it's been attempted.
I'd like to know more about the people that were trying to have the baby. It says their other kids have medical issues. Did they know about those kids' issues before they were born (and not elect to have the pregnancies terminated)? How severe are their medical issues? Still stupid to attempt another pregnancy but I wonder if they thought "we can handle medical issues but this is SO severe, this pregnancy ought to be terminated". Dunno.

I personally would abort a baby that had heteropaxy and holoprosencephaly since babies with that condition are usually vegetables, that is if they don't die shortly after birth. But she was born and for both the bio and surrogate to ditch the poor baby is disgusting. I think they're all scumbags.
