O.K. it was in Dubai, not Australia.....and I have already forgotten her name......Victoria Mcgrath (sic). She and friend were both killed in auto accident.....

I hadn't heard about her dying, blueberry.

I just read that she and her friend were killed in Dubai last month by drunken vacationers speeding in a rented Ferrari. Sad.

I remember seeing her on the news as a bombing survivor; energetic college student who suffered nerve damage in her leg.

Death Penalty Overturned

Well, the surviving terrorist brother behind the Boston Marathon bombing won a major victory in Appeals court today.

Turns out a couple of the jurors had posted negative comments about Tsarnaev on social media prior to being selected as jurors.

The federal appeals court overturned the death penalty sentence of Boston Marathon bomber Dzhokhar Tsarnaev (pictured above), saying the judge who oversaw the case did not adequately screen potential jurors for bias. 

The three-judge panel of the 1st US Circuit Court of Appeals in Boston upheld much of Tsarnaev's conviction, but ordered a lower-court judge to hold a new trial over what sentence he should receive for the crimes that he was convicted of, which were eligible for the death penalty.

So, now we'll see if a new jury sentences the convicted terrorist murderer to death again, or if they instead hand down a lighter sentence.  

Personally, I don't care if there's a new sentencing verdict so long as the only other option is life without the possibility of parole.

I haven't seen an estimated sentencing date or verdict options reported yet.

I don't know how they found an impartial jury, the only ones not tweeting negative comments about him are people that don't have twitter accounts.

I saw that. A federal sentence would insure the death penalty and not be tied up with state issues, I think he should be put to death but time will tell. Didn't he run over his own brother? Like a speed bump. That's what they call him around here. "speed bump"

Tsarnaev struck his older brother with a car as he fled the crime (don't know if it was intentional or not).  The older brother died the same day.

The official story, IIRC, is that the older brother continued fighting with law enforcement after he was struck and was killed by law enforcement officers thereafter.

It's not a state issue, in any case.  Tsarnaev was originally tried in federal court and the sentencing retrial will be held in federal court as well.

The jurors who are selected to be on the re-trial sentencing jury won't be required to sentence him to death; they'll have other options just like the original federal jury did.
