donovan for defense tried to rattle or discredit Dr. Petit's memory on stand today. it's a dumb move and will alienate jurors who are sympathetic. the evidence shows what happened, Dr. Petit's memories aren't an issue. even appearing to attack Dr. Petit is a poor defense tactic.

Dr. William Petit Jr. testified Tuesday about the beating he suffered the night of July 23, 2007, when two men broke into his Cheshire home and attacked his family. It was the second trial at which Petit gave his account of the attack, which left his wife, Jennifer Hawke-Petit, and their daughters Hayley and Michaela dead.

Petit was the first witness on the stand Tuesday. At the lunch break, he told The Hartford Courant that testifying the second time "was more nerve-wracking. I tried to stay calm."

At Hayes' trial last year, defense attorneys did not cross-examine Petit.

But Jeremiah Donovan, one of Komisarjevsky's defense attorneys, cross-examined Petit early Tuesday afternoon.

In brief but pointed questions, Donovan asked Petit about what he remembered vs. what he may have pieced together, based on testimony Petit has heard at both trials.

This is a truly horrific tragedy.
I really hate that so many states dont have
or wont use the death penalty.

Prosecutor Gary Nicholson showed Cheshire firefighter Rick Trocchi a photograph of a body found in the Petits' burning home. He asked Trocchi who it was.

"Hayley Petit" .

Prosecutors passed the photo around in a folder to the jury. Some looked intently at the photo while most looked quickly before passing it on. One woman looked at the Petits and sighed deeply.

At the morning break, as jurors filed past Komisarjevsky to exit the courtroom, they averted their eyes from him.

Before jurors viewed the photographs, defense attorney Jeremiah Donovan objected to the photos being shown, saying he was concerned that they would impact jurors' ability to judge the case fairly.

Some of the jurors hearing Joshua Komisarjevsky's case Wednesday seemed visibly upset by photographs of the victims of the 2007 Cheshire home invasion and fire, which left Jennifer Hawke-Petit and her daughters Hayley and Michaela Petit dead.

Though jurors seemed to hold back their emotions while viewing photos of the bodies of Hayley and her mother, some appeared visibly shaken by the photo of Michaela's body.

One woman looked stunned. Another cried and covered her face, using her shirt to dab her tears.


In the third day of testimony, Capt. Jay Markella described discovering Michaela's body.

He said the lower half of her body was hanging off the bed. Her arms were over her head and her hands were tied to the bed.

"I knelt down and immediately knew Michaela was not alive," Markella said.

A judge's decision to abruptly end Wednesday's proceedings in the trial of Joshua Komisarjevsky was a signal of just how rough the evidence and testimony in the deadly Cheshire home invasion case had been.

Jurors viewed horrific crime scene photos showing the bodies of Jennifer Hawke-Petit and her daughters, Hayley and Michaela, and listened to much of Komisarjevsky's chilling audiotaped statement about the events of July 23, 2007.

In a deep and steady voice that rarely wavered, Komisarjevsky told police that during the home invasion, he talked with 11-year-old Michaela Petit in her bedroom about music, "school and summer plans."

Then, with Michaela tied to her bed, "one thing led to another and I ended up having or performing oral sex on her — on KK," Komisarjevsky said. Komisarjevsky said he had heard her mother and sister call Michaela "KK," her family nickname.

Michaela later died in the burning house, along with her sister and mother in one of the most horrific crimes in recent state history.

"Was it against her will?" Det. Joseph Vitello asked Komisarjevsky on the audiotape.

"Um, it started off as against her will and then like, she wasn't like resisting or anything, so I just kept doing it you know," Komisarjevsky replied.

With one female juror in tears and others visibly shaken, Superior Court Judge Jon C. Blue cut short the recording and recessed for the day.

"I understand one of the jurors is having a tough time," Blue said. "This would be a good time to stop."

Michaela's father, Dr. William A. Petit Jr., and other members of his family appeared stunned and grief-stricken as they listened to the recording. After Blue recessed court for the day, family members gathered around Petit, crying and hugging.

NEW HAVEN — Proceedings in the Superior Court trial of Joshua Komisarjevsky began this morning with concerns from the judge about jurors showing up late and word from prosecutors that they will not fight the release of the audiotape of Komisarjevsky's police statement.

Judge Jon C. Blue said one or two jurors have "developed a habit" of showing up late.

He urged jurors to arrive at the courthouse about 15 minutes before the start of 10 a.m. testimony. Blue said tardiness could make the already long trial even longer and frustrate other jurors.

Hayley Petit died of smoke inhalation and carbon monoxide poisoning, an associate state medical examiner who performed the autopsy on the 17-year-old girl who died in the Cheshire home invasion testified Monday afternoon in Joshua Komisarjevsky's trial. Death would have overtaken the girl in as little as a few moments as her body suffocated, said Dr. Malka Shah.

Shah said she found burned remnants of rope tied around Hayley's right wrist and ankles and soot in her nose and mouth. The remains of her clothing smelled of gas.
Hayley had burns all over her body, but Shah said she could not determine whether the burns occurred before or after death.

Under questioning by prosecutor Michael Dearington, Shah said the rope on Hayley's wrist was tightly tied in a square knot.

The evidence suggests Hayley, who died face-down in the hallway, was able to free herself from the bed by breaking the rope ties.

Earlier, prosecutors took the jury inside the Stop & Shop supermarket on July 22, 2007, where Jennifer Hawke-Petit and her younger daughter, Michaela, 11, shopped for the family's last dinner together before the slayings. Monday would have been Hawke-Petit's 53rd birthday.

Supermarket surveillance photos captured Hawke-Petit and Michaela — referred to as "females of interest" by Lucinda Phelan — in unguarded moments browsing the produce aisles.

Michaela, wearing a sleeveless shirt and ponytail, can be seen carrying a bag of tomatoes. 21 In the courtroom, Dr. William A. Petit Jr., the sole survivor of the home invasion, stared up at the photos of his wife and daughter displayed on a movie screen as his sister, Johanna Petit Chapman, placed her hand on his back.

Prosecutors say it was during this shopping trip that Komisarjevsky spotted Hawke-Petit and Michaela exiting the store and followed them to their home.

Jurors also saw surveillance video from the bank ATM inside the supermarket, where Michael Ranno testified he withdrew money to pay Komisarjevsky for a roofing job. The prosecution compared the time on the supermarket's video with the bank's photos, to show that Komisarjevsky was at the Stop & Shop at the same time as Hawke-Petit and Michaela.

Is it possible that this is the 1st time Dr. Petit heard about what this guy says he did to Michaela? Just wondering if this was a shock to him or if he had heard it before from LE etc..
