3. The defendant desecrated the victim's body to hinder prosecution of the offense.

Channel Seven news here in Australia have presented a video of Emily Dietrich (Biological Mother) reacting as she read through the reports today. Particular focus was given to her breaking down while reading the autopsy report (and understandably so - it's a tough enough read without being involved!). I can't find the video online yet to share, but some of the transcript is given in the news link below, it's incomplete though... her last line was something like "He should have been fighting for her, instead of fighting for himself". She also said something on the lines of (this isn't an accurate quote here) that she hoped that Elisa lived out each of the days in the thirty years suffering the pain of what she did. Perhaps someone else might have better luck in finding the video to replace my misquoting?

a forensic anthropologist would be needed to prove this...but there were many tool marks (cuts) on Zahra's bones. and not all at sites where dismemberment would logically occur by a saw. was she stabbed and knifed in life??

Hickory, NC -- Adam Baker was interviewed by WBTV, a CBS-affiliate, just hours after his wife was charged with second degree murder in connection to his daughter's death.

Elisa Baker, Zahra's stepmother, was indicted on the charge Monday. She has remained jailed since charged obstructing justice in the investigation by writing a fake ransom note that was found when the girl was reporting missing in October.

Baker said he jumped up and down for joy and is relieved there will be justice for Zahra. He has said all along that he had nothing to do with Zahra's death or dismemberment.relieved he's not charged. yet. he's a victim now. bastard. dumb as hell too.

Baker said he didn't know anything was going on because Elisa Baker hid the truth from him. He calls her manipulative and abusive.

He said he would check in Zahra's room when he got home from work at night and saw what he thought was his daughter sleeping. When asked when the last time he saw his daughter alive, Baker said he couldn't comment because of the police investigation.I DO NOT BELIEVE THIS RETARDED LYING SHITSCUM. neither does anyone else it appears.

He says he will stay in the country as long as he needs to until the case is over. He eventually wants to go back to Australia with Zahra's remains.he will stay in the country because hopefully the police have his passport and he still has bad check charges to face in court.

Investigators have not said how the 10-year-old died. An autopsy released Monday showed several bones with cutting marks, consistent with dismemberment. Her skull is still missing.

IT SEEMS beyond belief. Adam Baker's 10-year-old daughter, Zahra, was a cancer sufferer in need of constant care. How could she just go missing from her father's notice for 15 days?

Police believe Adam’s wife, Elisa Baker, murdered Zahra on September 25 last year and scattered her remains in bins and woodlands outside of the town of Hickory, North Carolina.

Yet it was not until October 9 that Adam Baker noticed that Zahra was no longer in his life. He decided to call the police.

Elisa Baker, 44, has been charged with second degree murder and faces up to 30 years in prison. The manner in which Zahra died has not been revealed.

Adam Baker, 33, told a local television station that he had been working long hours at his mulching job and was leaving for work and coming home when Zahra was in bed.

Mr Baker’s mother, Karen, 53, of Newcastle, has been in North Carolina with her son since her granddaughter’s partial remains were discovered in October. she backed up Adam’s story.

“Adam was working long hours,” she told News Ltd from the apartment where she is staying with Adam, just out of Hickory.

“He would go into Zahra’s room and she (Elisa) had made up the bed to make it look like she was in bed asleep.”

She agreed it sounded hard to believe. “Honestly, I don’t have all the answers,” she said. “He doesn’t either. I know it’s very hard to understand. A lot of it is still not to be talked about, because we have a trial coming up and there’s nothing we will do to damage that.” a handy crappy excuse.

Karen Baker pointed to one of the charges against Elisa Baker which states that she “secreted the victim from family and others prior to and after the offence”. Karen said Elisa had fooled many people, including men she married when she was not yet divorced.

Karen said when Elisa Baker married her son in Australia in 2008, she “spun big stories that you didn’t always believe, but she was so good with Zahra. She really was. I’m serious.

“But she is a master of deception. Adam only found out later she’d been married seven times. She’d only been married once, according to what we thought in Australia. She had to produce her previous divorce papers to marry Adam, and she did.”

She said she and her son were relieved that Elisa Baker had been charged, and did not share the common sentiment in this area that she should have been charged with first-degree murder so she could face the death penalty by lethal injection.

“Death would be too good for her,” said Karen Baker. “I hope she lives with this every day of the rest of her life.”

A Catawba County grand jury yesterday said Elisa Baker had “unlawfully, willfully and feloniously did of malice aforethought kill and murder Zahra Clare Baker”.

It is understood Elisa Baker cut a deal to reduce the first-degree murder charge – and thereby avoid the death penalty – in exchange for leading police Zahra’s remains. However, the child’s skull, which would most likely reveal the cause of death, has not been found.

Zahra’s autopsy -- also made public yesterday -- showed cut or tool marks on her skeletal remains, caused when she was allegedly dismembered by Elisa Baker inside her own home.

Somehow, Adam didn’t notice.

Elisa Baker, the accused killer of her stepdaughter, Zahra Clare Baker, was indicted for fraud Monday by a Caldwell County grand jury.

Baker was indicted on two counts of financial identity fraud and two counts of obtaining property by false pretenses.

Those charges follow a second-degree murder indictment Feb. 21 by a Catawba County grand jury. Baker also is accused of obstruction of justice in connection with Zahra’s murder and disappearance and bigamy.

Presenting evidence gathered in an investigation by the Caldwell County Sheriff’s office, prosecutor Eric Bellas laid out the case against Elisa Baker to the grand jury.

Baker allegedly obtained telephone and other services for her residence using the driver’s license number, Social Security number and date of birth of Brittany Starbuck. Those offenses occurred on or about March 19 of last year, the indictment stated.

Starbuck, 21, is Elisa Baker’s daughter.

The fraud occurred on March 19 last year, according to the indictments. At that time, Baker, her husband Adam, and Zahra lived at 4010 Phillip Lane in Hudson, according to the indictments.

Baker also used Starbuck’s identity to obtain electric utility service for the Baker residence on or about April 3, the indictments states.

Financial identity fraud and obtaining property by false pretenses are felonies. North Carolina law holds harmless the person whose identity was stolen.

NEWTON, NC (WBTV) - The attorney for Elisa Baker said Monday he doesn't think his client can find an impartial jury anywhere near Catawba County where she is in jail awaiting her day in court.

"I can't imagine her getting a fair trial in this area, and I can't think of an area around here where she can get a fair trial," said Attorney Scott Reilly.

Elisa Baker is charged with second-degree murder and obstruction of justice in the death of Zahra Baker.

She also faces seven other unrelated felony charges ranging from bigamy to obtaining property by false pretense.

Two indictments on the latter charge were handed down Monday by the Catawba County Grand Jury.

The indictments alleged that Baker pawned two items she did not legally own, a television and a pressure washer, at Hickory Pawn and Gun shop.

Most of the felonies Baker faces do not carry long jail sentences, if she is convicted.

"She's entitled to a fair trial in every single case no matter how big or small," said Reilly.

Reilly said Baker will plead 'not guilty' to every charge when the time comes.

He also said, at some point, he will file motions for a change of venue in each case.

Yeah Adam Baker is a lying sack of shit. Even when I work 20 hour days I still go to my son's room to check on him. But, I guess if you always lock your only child up for days at a time, you wouldn't miss her much, would you? They should charge them with child abuse also! I can't believe that the state didn't step in for the poor girl. I've seen children taken away from their parents for any suspicious bruising, let alone malnutrition. The case workers should be charged for neglect as well.

Baker is charged in the death of 10-year-old Zahra Baker, whose remains were found in November of last year.

It’s unclear what caused Baker to collapse during the hearing in Newton.

During the hearing, defense lawyer Scott Reilly said he will push to move any trial out of Catawba County because of all the publicity the case has received.

Still doesn't address the glib manner in the 911 call, the weird 'she's brooding' comment, a veritable mountain of evidence of outright neglect (he didn't stop the abuse, at the very least...even knowing about it).

The lawyer for the woman accused of murdering 10-year-old Australian girl Zahra Baker in the US has complained his client is being treated differently because of the publicity around the case.

Looking slightly disheveled, Elisa Baker, 42, shuffled into court in North Carolina with her hands and legs in shackles.

She was expected to enter a plea but that did not happen.

Lawyers are still arguing over whether she can get a fair trial in Newton, or whether the case should be moved.

Defense lawyer Scott Reilly said forcing his client to appear in court while lawyers discussed how to proceed with her case was unnecessary.

"I just think she's being treated differently, quite frankly, and I want to ensure that doesn't happen," he said.

He says Baker cannot get a fair trial near the town where the 10-year-old lived.

HICKORY, NC (WBTV) - The father of 10-year-old Zahra Baker, who was killed and dismembered last fall, was arrested by police in Hickory on Tuesday and faces felony charges.

According to police, Adam Baker was arrested and charged with one count of Identity Theft and one count of Obtaining Property by False Pretense. Both of these charges are felonies, police say.

Police told WBTV that the charges filed on Tuesday are related to obtaining services from Duke Energy and are not related to the death of Zahra Baker.

WBTV has learned that Baker was charged by police after getting power to his home in Hickory under false pretenses. His wife, Elisa, is facing similar charges in Caldwell County from when the couple lived there.

On Monday, WBTV learned that Baker was seeking to leave the United States and head back to his home country of Australia.

A meeting between police, the district attorney and Adam Baker's attorney was scheduled for Tuesday to see if Baker can get his passport back for an eventual return to Australia. WBTV has learned that the meeting has been put on hold for now.
