NEWTON, NC (WBTV) – Adam Baker said Tuesday he wants "justice for Zahra" and said when his wife goes to trial on a charge of second degree murder in the death of the little girl, he plans to be there to "make sure Elisa gets what she deserves."

Baker made the comments as he left the courthouse in Newton where a criminal hearing on charges he faces that are unrelated to the death of his daughter was delayed until Tuesday morning.

Baker said he thinks about his daughter every day and has visited a memorial that is under construction on Christie Road in Caldwell county where some of Zahra's remains were found.

"I go there all the time," he said.

In an exclusive interview with WBTV News earlier this year, Baker said that he considered Elisa "manipulative and a liar."

He said on Monday that he still is surprised by all the revelations that keep coming out about her.

"I'm surprised all the time," he said.

Adam said the recent indictments of Elisa on drug charges was another case of that. Baker said he knew nothing about the alleged drug deals that federal authorities have charges Elisa with. FUCKING LYING SHITHEEL.

He said he knew she was taking prescription pain killers, but never saw anything that indicated she was selling them.

Elisa Baker is to appear in superior court on Thursday where a judge will listen to motions from the defense and prosecution in Baker's second degree murder case.

Among the motions expected to be considered is a request from the defense that the trial be moved because of publicity.

Adam Baker is scheduled to appear in court Tuesday morning in an administrative hearing where motions will be heard in his cases where he is accused of using another person's name to obtain electricity service.

Baker is also being monitored by federal immigration authorities. He is wearing an ankle monitoring device and has to report to immigration agents in Charlotte once a week.

Baker said he hopes to get the charges and immigration matters settled soon.

All Baker wants to do now, he says, is "Get this all behind me, and take Zahra back to Australia and finally put her to rest."

Elisa Baker sat silently during Thursday’s administrative hearing in Catawba County’s Superior Court.

The woman accused of murdering and dismembering her 10-year-old stepdaughter, Zahra Baker and hiding the remains, sat with her chained hands folded on her lap while the judge, defense and prosecution discussed her charges and made sure everything is in order as her case moves toward trial.

Baker is facing nine felony charges, including second-degree murder and obstruction of justice. She’s facing more than 20 misdemeanor charges as well for crimes like passing bad checks and communicating threats. On top of that she’s facing seven federal drug charges for allegedly trafficking in prescription pain killers.

Several procedural matters were discussed at the hearing.

District Attorney Jay Gaither told Superior Court Judge Timothy Kincaid that he intends to try Baker on murder charges after her additional felony cases are concluded.

After the hearing, Gaither said that Baker committed her other crimes before she killed Zahra and she’ll be tried for them first. He did not address the fact that, according to state sentencing guidelines, Baker will do more prison time for a murder conviction if she already has prior felony convictions.

A North Carolina woman accused of killing her disabled stepdaughter is scheduled to be arraigned in court on Monday.

Elisa Baker is charged with second-degree murder and obstruction of justice in the death of Zahra Baker, the 10-year-old Australian girl who had a prosthetic leg and hearing aids because of her fight with bone cancer.

Baker, 43, will be arraigned Monday on those charges.

Also, a judge plans to say where he's moving the trial. Superior Court Judge Timothy Kincaid agreed to move the trial, citing intense pretrial publicity.



A hearing in the case of a North Carolina woman accused of killing her 10-year-old disabled stepdaughter has been postponed after attorneys spoke with the judge.

Lawyers appearing in Catawba County Superior Court Monday said they had spoken with Judge Timothy Kincaid, who agreed to move the hearing to Wednesday morning. Prosecutors and defense lawyers for 43-year-old Elisa Baker wouldn't explain the reason for the delay.

Prosecutors and defense attorneys are in negotiations that could put an end to the nearly yearlong murder case of 10-year-old Zahra Baker of Hickory.

Defense Attorney Scott Reilly told the Observer on Monday night that he is in discussions with District Attorney Jay Gaither on resolving the second-degree murder charges against Zahra's stepmother, Elisa Baker, possibly as early as Wednesday.

"We're having productive discussions and we're working toward the goal of resolving the cases," he said.

On Monday, Elisa Baker returned to Catawba County court for a change of venue hearing. But Superior Court Judge Timothy Kincaid postponed it until Wednesday to allow the attorneys to continue negotiations.

Reilly would not discuss specifics of any plea deal, but said he wants to advise his client on her best options based on the prosecution's case. If convicted of second-degree murder, Baker could face as few as eight years - or as many as 30 - in prison.

HICKORY, N.C. -- Elisa Baker has pleaded guilty this morning to second degree murder in the death of her 10-year-old stepdaughter, Zahra.

Baker also pleaded to aggravating factors of hiding the crime and desecrating the body of Zahra. She pleaded guilty in obstruction of justice, and to charges unrelated to Zahra.

The other charges unrelated to Zahra are of bigamy, identity fraud, and obtaining property by false pretenses.

According to the plea agreement Baker could spend between 14 to 18 years in jail.

Elisa Baker pleaded guilty today to second-degree murder in the death of her 10-year-old stepdaughter, Zahra Baker, and will serve 14 years and seven months to 18 years in prison.

It is the "collective opinion" of investigators that Adam Baker was not involved in his daughter's death or dismemberment.

In testimony today, police said Elisa implicated Adam Baker in the dismemberment and disposal of Zahra's body, but cell phone records indicated that Adam was not involved.

Baker told investigators that she discovered Zahra not breathing and unresponsive at 4 p.m. on September 24 and tried to revive the girl with CPR, according to police testimony given Thursday.

After the CPR failed, she said she called Adam Baker, who came to the Hickory home at 5:00 or 5:30 p.m. Elisa said that the two decided together that they "couldn't call 911" and that they disposed of the body.

On hearing this testimony, Adam Baker shook his head and swore.

Elisa Baker told police she found Zahra around 4 p.m. on Sept. 24, unresponsive in her room, said Cpt. Thurmond Whisnant on the stand Thursday.

Elisa Baker told police she tried CPR for 20 minutes, but was unsuccessful, Whisnant said.

Baker added that Zahra wasn't feeling well that day, according to Whisnant.

Another investigator said Thursday that many of Zahra's blood drops were found in Zahra's room after they examined it carefully.

After Zahra was found by Elisa Baker, she then called Adam Baker who was at work and told Adam what happened. Adam came home and said they could not call 911, Whisnant said.

But later on the stand, Whisnant testified that when they looked at Elisa Baker's cell phone records and the calls that were made to and from Adam Baker.

Those calls, Whisnant said, show that:

At 2:33 pm Elisa Baker was home
At 2:45 pm Elisa Baker was traveling on 321
Then 3 phone calls made in the Christy Road search area, where some of Zahra's remains were found.

Between 3:30-4 a phone call was made in the International Drive area, where other items were found, Whisnant said.

By 4:45, Elisa Baker was back home.

Whisnant later said Thursday that Elisa Baker was still sending text message to Adam Baker in early October 2010 that implied that Zahra was still alive at that point.

Adam Baker told police around that time that he worked many hours and rarely saw his daughter.

"Since May, I've smoked more marijuana than I've spent time with my daughter," Adam Baker told police around that time, Whisnant said Thursday.

Major Clyde Deal of the Hickory Police revealed on the stand Thursday that before Oct. 24, 2010, there were 340 investigative events of which 58 were searches for Zahra. Police also searched landfills looking for a mattress.

After Oct. 24, police then got a call from defense lawyers saying Elisa Baker was willing to offer assistance in finding Zahra's dead body. Police said that they likely would not have found Zahra's body without help from Elisa Baker.

Parts of Zahra's body were found in multiple sites around Hickory months after her disappearance was reported. Zahra's armbone, prosthetic leg, torso and pelvic area were found, investigators said for the first time in court Thursday.

Police said Thursday that they also found a saw, which they believe was used to cut up the girl's body. A vertebrae and other bones of Zahra were also found with saw cut marks on them, an investigator said Thursday.

But Zahra's head and many other body parts were never found.

After the plea was announced Thursday morning, the prosecutor in the case said that the family of Zahra is entitled to the cost of transporting the child to Australia for a proper burial.

Zahra's remains are held as evidence and the prosecutor said he will request this after testimony.

She wasn't the child's stepmother, because legally they weren't married. She killed a disabled child. I hate bad parents too. When you have kids, your needs go to the bottom of the list. Why is that concept hard to follow? It's a natural instinct.

I see the gothic fairy has lost weight, i wonder if they are feeding her? I would say her jail term is going to be long. I don't believe Adam is innocent either. If only the 911 phone call, it was not desperate, it was quite casual when he rang to report his daughter missing. It does not add up. They were in it together. What a gross couple.

Unbelievable that this POS woman will only serve up to 18 years. I can't understand why such a generous plea deal given everything little Zahra was put through when she was alive, and the gruesome way her body was handled after her death.

Her father may not have been involved in Zahra's death or dismemberment, but he as much admits that he neglected and endangered the poor child. He is also a royal POS and should not get off without at least a few years in the slam, imo.

This plea deal is very disappointing.

They are both guilty and despicable, regardless of who actually played what role. If either of them had been decent people, Zahra would be alive. If the DAs office entered this plea agreement out of laziness, it's a terrible injustice to Zahra. She was radiant and innocent and her father and his internet hussie are both evil losers. LENOIR Adam Baker, whose wife pleaded guilty to murdering his 10-year-old daughter, Zahra, says he feels like a hostage.

He can't return to Australia while the felony and misdemeanor crimes he's been accused of committing remain pending. And he can't work, he says, because he's been accused of being in the country illegally.

"I want to go back to Australia. So I can take Zahra back home," Baker told the Observer Thursday as he sat in a courtroom at the Caldwell County Courthouse waiting to find out if prosecutors would dispose of the charges against him.

Baker, 34, is charged in Caldwell County with assault with a deadly weapon, two counts of communicating threats, failure to return rental property and five counts of writing worthless checks. The offenses are all misdemeanors, and on Thursday the cases were continued until January.

Baker also is charged in Catawba County with felony identity theft and felony obtaining property by false pretense. He's scheduled to appear in court on those charges on Monday.

None of the charges relate to Zahra's death. All the misdemeanors have been pending since 2010.

"I don't intend to plead guilty," Adam Baker told the Observer.

Adam Baker's attorney, Shell Pearce, also expressed frustration Thursday that his client's misdemeanor cases had been postponed until 2012.

"We were ready to go to trial," Pearce told reporters. "Adam wants it over. The man says he's not guilty."

Adam Baker’s Catawba County attorney is seeking to have Baker’s trial on two felony charges moved to another county, saying Baker’s name is too well-known for him to receive a fair trial here.

Baker is the father of 10-year-old cancer survivor Zahra Baker. Zahra was reported missing in October 2010, and her remains were found later that fall. Her stepmother and Baker’s wife, Elisa, pleaded guilty to Zahra’s murder in September, and was sentenced to 14 to 18 years in prison. Baker was not charged in Zahra’s death.

Baker’s attorney, Mark Killian, said Baker’s name has been splashed in media outlets as a result of the investigation into Zahra’s murder.

Baker is charged with identity theft and obtaining property by false pretenses, accused of using a relative’s name to get electricity at his Hickory home on 21st Avenue, NW, in August 2010.

“It’s all over the local papers in this county and surrounding counties,” Killian said. “I’d like to have the trial outside the Charlotte market.”

He was not specific about a new location.

In the motion, which was filed Nov. 3, Killian said although Baker had nothing to do with Zahra’s death, that doesn’t seem to matter to the public.

The motion states: “While the defendant’s current charges are unrelated to the death of his daughter, and further despite the lack of any credible evidence that defendant was involved in the disappearance and murder of his daughter, there exists in this county a widespread belief that defendant was criminally involved in his daughter’s death.”

During Elisa’s plea hearing, Hickory investigators testified there was no credible evidence to suggest Baker was involved in Zahra’s death or dismemberment. However, Elisa has maintained that Baker helped dispose of Zahra’s remains.

Killian’s motion said information on TV, radio, online and in print has “so polluted” the jury pool that it’s unlikely an unbiased jury would be found in Catawba County.

Killian said he has talked with Baker’s Caldwell County attorney, Shell Pearce, but said he did not know if Pearce planned to file a similar motion.

Baker, an Australian native, currently has an immigration detainer placed on him by the US Immigration and Customs Enforcement. Killian said Baker must check in with ICE, though not with the weekly frequency he used to.

Because of his immigration status, Baker is unable to work in the United States. Killian said Baker is living with friends at the moment.

“He’s stuck between the proverbial rock and a hard place,” Killian said.

Baker’s next court date on the Catawba County charges is Jan. 3, and Killian said he expects the change of venue motion will be heard then.

The North Carolina Medical Examiner's office in Chapel Hill released the remains of Zahra Baker last month to a Hickory funeral home, where they were cremated and given to her father.

Adam Baker says he wants to return to Australia and give Zahra a proper service and burial there. Baker can't leave the country until he resolves criminal charges alleging several misdemeanors and two felonies unrelated to the girl's slaying.

Her stepmother, Elisa Baker, has been sentenced to up to 18 years in prison for the murder of her disabled 10-year-old stepdaughter.
