Illegal in most states due to wage laws unless its a group of 5 or more, supposedly. If you're solo subtract it from the bill and let the server know up front they're working for the tip Smiley_emoticons_biggrin

Actually, (unfortunately) I found out the hard way. We were at this restaurant with a few friends. And they wanted to get separate checks, cause they usually drank 2 bottles of expensive wine. (When we do have wine, a glass is usually enough for us.)
As it turned out my bill came first, I added a 18% tip, and paid bill.
When the other couples got their bill, one of them noticed the automatic 18 % tip already added in the bill. My fault for not noticing, I gave a "36"% tip!!! hah
